提纲
1、(正面)对于法律的看法因人而异。
2、(正面)法律和道德不一样,是有强制性的。
3、(反面)社会上的确存在不合理的法律,需要通过司法途径解决。
There are always some phenomenons existing in the society that some people may be regarded by majority of society as criminal but never be punished by law. Some laws are as well criticized by people for discrimination and unjust. Confronting with this situation, in my opinion, although there are indeed some unreasonable laws, through legislation process to solve it will be a wiser method.
To begin with, What we should first keep in mind is that it's hard to determine whether a law is just or not. The function of law is to protect majority's interests and prevent them being violated. Thus, according to people's different interests, a same law will be viewed as just and unjust by different people. The inheritance tax, for example, will be regarded by rich people as unjust law since it takes away most of their fortunate without any payoff. However, the inheritance tax is actually beneficial for most of people in society because it effectively avoids the gap between rich class and poor class to become larger. In fact, there is no such law that is absolute just or unjust. Law is the result of striking balance among competing interests. and those people holding the view that they can disobey the unjust laws lack of thoughts and also are dangerous.
Furthermore, The law is totally different from morality. it has the compulsory power and individual in society must obey it so that the stability of the whole country can be guaranteed. Many issues may be thought as unmoral, however, they are not against the law. Once one person is against the law, even which is regarded unjust, the punishment of law must be carried out. if the law fails to execute, many other people will imitate this bad example. As a extreme result, this law will never be obeyed by people again.
Admittedly, some existing laws are really unjust for the reasons that some laws are out of date or some laws are criticized by groups of different interests, and these laws need to be corrected in a legislation process. In America, some laws, which support abortion and homosexual, are hard criticized. The critic points out that these laws are against humanity and destroying the ethical principle. To solve this tough issue, comprise in different interests and mutually communicating between different groups is essential. However, arbitrarily disobeying these laws is apparently unwise and may be counterproductive to help make progress of the law system.
Last but not least, Every issue existing in our society is more complicated that it seems. The speaker's simple claim may arouse many people's illusion that they have found a reason to disobey the existing regulations, which will only make things worse. Our attitude toward law should avoid these simple claim and be more reasonable. 作者: yiyang1107 时间: 2010-2-25 17:14:42
To begin with, What we should first keep in mind is that it's hard to determine whether a law is just or not. The function of law is to protect majority's interests and prevent them being violated. (法律的功能最好你再确认一下,或者在law功能之前加个之一;关于law的定义参考韦氏词典)Thus, according to people's different interests, a same law will be viewed as just and unjust by different people. Law is the result of striking balance among competing interests. and those people holding the view that they can disobey the unjust laws lack of thoughts(不符合英文表达习惯,而且容易引起歧义)
and also are dangerous.(是否可以这样“选择不遵守法律是不理智和鲁莽的行为”)
Furthermore, The law is totally different from morality. it has the compulsory power and individual in society must obey it so that the stability of the whole country can be guaranteed. Many issues may be thought as unmoral(换成名词), however, they are not against the law. Once one person is against the law, even which is regarded unjust, the punishment of law must be carried out. if the law fails to execute, many other people will imitate this bad example. As a(an) extreme result, this law will never be obeyed by people again.
Admittedly, some existing laws are really unjust for the reasons that some laws are out of date or some laws are criticized by groups of different interests, and(这个地方我感觉不是并列关系,是否可以这样“不得不承认一些法律需要修改,,,,你说的那两条,但是这个法律需要通过合法的手段而不是不遵守”,这样正好也和上一段形成呼应) these laws need to be corrected in a legislation process.
Last but not least, Every issue existing in our society is more complicated that(than?) it seems. The speaker's simple claim may arouse many people's illusion that they have found a reason to disobey the existing regulations, which will only make things worse. Our attitude toward law should avoid these simple claim and be more reasonable.
