But in fact, there are two types of laws and we need to distinguish them clearly. We should obey the just laws and disobey and resist unjust ones.

Undoubtedly, every citizen should obey just laws as they depend on people’ interest and benefit. As it is defined, laws may require or proscribe, or even restrict given actions, as well as empower citizens to engage in certain activities, such as entering into contracts and drafting wills. Laws may also simply mandate what procedures are to be followed in a given context; for example, the American Constitution mandates how Congress, along with the President, may create laws. A more specific example might be the Securities Exchange Act of 1934, which, along with the Securities and Exchange Commission, a regulatory body, mandates how public companies must go about making periodic disclosures to investors. So abeyance of just laws limits the behaviors of the strong groups and individuals and ensure them do not use their powerful positions in society to take unfair advantage of weaker individuals. Also, it is a fact that these just laws embody the benefit of the public and the society.

Yet it is more important for individuals to resist unjust laws, in order to contribute the legal system of a nation. First, laws are sometimes created that people later recognize as being unjust or unfair. Laws need to be amended under the development of the society. It embodied the purpose of the rulers in the past as in the feudality, but laws serve as a tool to protect the benefit of public nowadays. In a democracy, anyone who feels that a particular law is flawed has the right to speak out publicly and to seek to change the law by lawful means. Second, unjust laws emerge as a tool for the people with a great power to obtain their benefit. It is properly for them to abuse power and ignore the existence of the right of the public. Without the resistance of the unjust laws from the public, people will lose the right to satisfy their own benefit and pamper the shady deal of the powerful and greedy persons.

A better approach is to appeal the authority to amend the law and get rid of the unfairness inside the law. Inevitably, every law has flaws. A true democratic society should allow individuals to challenge unjust laws through civil disobedience while the authorities, on the other hand, must keep open to advice and critiques and make earnest and cautious analysis so as to optimize the laws. This is a good way to sustain the stability of the societies as well as sweep away the injustices of the laws. Only when the unjust laws are amended and people satisfy with the just ones will the laws of a society become sounder and the life of individuals better. For example, the Constitution Amendment in many countries now, is an effective way to amend laws to satisfy the need of eras and indicate the public purpose. This policy undoubtedly rejects the unjust laws and factors and improves the development of our society.

Above all, every individual should obey just laws and resist or disobey unjust laws. They are both their rights and responsibilities. With the amendment of the unjust laws and obedience of just laws, a legal society can be constructed and improved better.
