我就觉得强调法律稳定性的时候,可以谈一下宪法之类的吧?比如规定国家体制,国家运行机制的法律,这些法律基本上是不能随意变动的
I generally agree with the speaker that laws should be flexible enough to take account of various circumstance, times, and places. But the consistency and stability of laws are also the things we concern [用we are concerned with?] which are critical for our community.
On the one hand, I concede that our society would be in chaos if laws are changed frequently. Without stable laws, people would have no standard to follow and no way to understand the obligation and rights. As we know in the modern world, the function of our society in economy depends on some laws. These laws protect the legality of personal property rights and liberty of individuals. If the laws are[是不是用were?表一种虚拟语气?] changed, the property of private industry would be seized without accumulation and the employees would have no freedom to choose their jobs[这句话是为了解释和例证前面那句话吧,这样的话,我觉得这样写好些: If those laws are not in fixed forms to some degree, for instance, the property of private industry would be in a dangerous, unstable situation, and rights of the employees also face a serious condition that the laws cannot give a firm protection for them]. Moreover, stable laws are also necessary in business to define the obligation and rights of suppliers and their customers. Without promise in contract to clarify the obligation and rights of both sides, their economic relationship could be undermined by the instinct of human beings such as greed, selfishness and jealousy without protection.
On the other hand, although there are some principles in laws we should insist, laws should be flexible enough to consider the times. Since our society is making progress day by day, it is necessary for us to keep laws in accordance with the pace of our community. History has shown us a good illustration in fields of economy. In the 19th century, it is commonly convinced in Europe that free transaction of capital among citizens or countries can thrive the market, since they believed the "unseeing hand" claimed by Adam Smith would surely serve to control the economic activity effectively. And it really worked at that time when laws were issued to prevent the economy from interference of governments. But when economy was repeatedly stricken by economic crisis and at last almost ruined by the tragedy in 1933, Keynesian revolution was introduced to constitute laws in order to let governments play a more constructive role in the economic life. As Keynesian insists, the free market could effectively distribute resource in different companies, but when it does not take good effect in crisis, it is government's duty to stimulate consumption.
Moreover, sometimes it is necessary to put forwards new laws considering the progress and challenge coming forth. Consider, for instance, the recent progress in biotechnology. After the first cloned sheep was born in England, more and more controversies were coming forth[springing up? arising? gushing out?] when considering the possible application of this technology on our mankind. It is now commonly cognized that the abuse of this immature technology on human beings would give rise to moral crisis, ethical embarrassment and technological uncertainty. To stop some scientists still lost in the research of cloning human beings, it is crucial to constitute new laws to overcome challenge from science and prevent the possible disaster.
In short, laws should be flexible enough to keep in accordance with the pace of our society and solve new societal issues come out due to the progress of science. However, when considering the consistency and stability of laws, it is necessary to keep some laws in order that we could understand the obligations and rights which are crucial to form a modern world. |
