No one can deny that unjust laws lived in every country, every times, even everywhere. Because each individual stands in a different point of view which only belongs to him or her own. But close examination reveals that most of these unjust laws conflict with basal humanity or prevent the development of human society. Obviously, any one has the responsibility to obey just laws and to disobey and resist unjust laws. Meanwhile, every person must be cautious to distinguish the unjust laws from other just ones.
Law serves a variety of functions. Laws control crimes directly contribute to maintain a peaceful, orderly, relatively stable society. Courts help to social stability by resolving conflicts in a civilized way. Property and contract laws facilitate business activities and private planning. Laws limiting the powers of rulers help to provide some degree of freedom that would not otherwise be possible. Law has also been used as a mechanism for social improvement; for example, at distinct times laws have been passed to restrain social discrimination and to improve the equality of individual right in matters of health, education, and welfare.
Many people believe the popular view of law overemphasizes its formal, coercive aspects. They point out that if a custom or norm is assured of judicial backing, it is, for practical purposes, law. On the other hand, a regulation which is neither obeyed nor enforced is an empty law. Social attitudes toward the formal law are a significant part of the law in process. For example, if most people disobey the traffic laws, all of traffic roads will become disorder and chaotic. Making a mad image that; cars are driving in the highest speed, walkers are across freely, and accidents are happened frequently. For instance, the laws which against human equal rights or violate fundamental humanity, people should not yield to these unjust laws. Civil Rights movement in the United States is the best illustration of this case. The civil rights movement was first and foremost a challenge to segregation, which is without reason at legal or social practice of separating people on the basis of their race or ethnicity. In sum, laws merely a tool which defined by humanity and in turn regulate our society, meanwhile it does not contain any attributes of subjective at all. Law develops as society evolves. Consequently, we had better change a point of view to understand it, like this, from the stand of development of society. If the construction of good social environment is benefited from the temporal laws, then the public should to obey and to keep the laws’ authoritative. On the contrary, if the laws against the improvement of society, we must against and reform them sooner or later. |
