It’s over simply to distinguish laws from just and unjust and it seems not very sound. In some sense, laws merely a tool which defined by humanity and in turn regulate our society, meanwhile it does not contain any attributes of subjective at all. Law develops as society evolves. Consequently, we had better change a point of view to understand it, like this, from the stand of development of society, favorable or not, further in reason or not to human society. If the construction of good social environment is benefited from the temporal laws, then the public should to obey and to keep the laws’ authoritative. On the contrary, if the laws against the improvement of society, we must against and reform them sooner or later.

To the beginning, often law is equal to regulation which defined by rulers and to confine the behaviors of the individuals, who including in the rulers own in the abstract. Whereas any varies of laws are determined by the needs of society’s development but not certain individuals at earth. For instance, historically, of the New World colonies, Brazil saw the harshest and most extensively documented repression against homosexuals. Ironically, today it is the country where they find strongest representation in the gay and lesbian movement, as reflected in political victories in the struggle for full citizenship, and in the number of Afro-Brazilian gay groups. This transform mirrored the progresses of the whole society and the needs of full development of human freedom.

Moreover, any resistances will be punished if they beyond the levels of value system and social improvement too much. If someone, however of the rulers or of the common people, insists on disobeying this discipline, he or she will pay a heavy price for this behavior. Consider, for instance, the tribunals of the Inquisition and the royal courts of Spain and Portugal tried for three centuries, tortured, and severely punished hundreds of gays, many of whom were burned at the stake. Perhaps these days, those poor men and women were not able to suffer so many pains, but at then, they had no choice, all of them became the victims of times.

When it comes to the rulers, it seems to be that they are always represent the authority, even equal to laws, for they are the executors of the laws. However, if their laws not adapt to the society or extremely crucial to the public, those rulers could not maintain law and order for long. As the laws, adopted by Japan and German, in the period of World War Two, obviously, were violate the humanity severely. Although they have strong military, they were forced to surrender at the end.


Finally, we should get down to the position of human beings to see the law. That must be more complexity to clarify the relationship between human and law, because we always in sight of law in a color glasses. Sometimes, more or less individuals are inclined to challenge the law when they believe some rules are not just, or more accurate, conflict with their values. For example, the controversial issue of abortion. Individuals with particular religious beliefs tend to view laws allowing mothers an abortion choice as unreason, while individuals with other value systems might view such laws as in reason. In short, the fairness of the law is subjective, depending largely on how one's personal values are affected by it.

法律仅仅是工具,我们最好从它对社会贡献来判断它的公正与不公正,作出合适的回应.

No one can deny that unjust laws lived in every country, every times, even everywhere. Because each individual stands in a different point of view which only belongs to him or her own. But close examination reveals that most of these unjust laws conflict with basal humanity or prevent the development of human society. Obviously, any one has the responsibility to obey just laws and to disobey and resist unjust laws. Meanwhile, every person must be cautious to distinguish the unjust laws from other just ones.

Law serves a variety of functions. Laws control crimes directly contribute to maintain a peaceful, orderly, relatively stable society. Courts help to social stability by resolving conflicts in a civilized way. Property and contract laws facilitate business activities and private planning. Laws limiting the powers of rulers help to provide some degree of freedom that would not otherwise be possible. Law has also been used as a mechanism for social improvement; for example, at distinct times laws have been passed to restrain social discrimination and to improve the equality of individual right in matters of health, education, and welfare.

Many people believe the popular view of law overemphasizes its formal, coercive aspects. They point out that if a custom or norm is assured of judicial backing, it is, for practical purposes, law. On the other hand, a regulation which is neither obeyed nor enforced is an empty law. Social attitudes toward the formal law are a significant part of the law in process. For example, if most people disobey the traffic laws, all of traffic roads will become disorder and chaotic. Making a mad image that; cars are driving in the highest speed, walkers are across freely, and accidents are happened frequently. It must be a crazy society.

反抗的必要性

Law is not completely a matter of just one forever; it also includes unjust respect.Law appeared just facet only when its accordance with right reason. In so far as it deviates from right way it is called an unjust law. Facing those unjust laws, every individual has the very responsibility to resist them. Following our forerunners, firstly, we must bright our eyes to distinct what is just law as well as what is unjust. For instance, the laws which against human equal rights or violate fundamental humanity, people should not yield to these unjust laws. Civil Rights movement in the United States is the best illustration of this case. The civil rights movement was first and foremost a challenge to segregation, which is without reason at legal or social practice of separating people on the basis of their race or ethnicity.
