180.”Many problems of modern society can not be solved by lawsand the legal system because moral behavior can not be legislated.” With increasingtechnological advances, it is increasing a common thing for individuals closelytake full use of it to take no efforts for personal profits. Consequently, alarge number of bad behaviors appeared, which can not be solved by today lawsand legal system. Such as tobacco manufacturers producing unhealthy, tobaccocloning technology, job discrimination, the phenomenon of false and so on. However, one gratuitouslyunfairly assumes that all problems results from moralbehavior can not be legislated. The statement is overlooked the otherfactors that might contribute to these problems.First of all,the conduct of the government policies and the discontent of thepeople led to immoral. Some local governments do not act in accordance with thelaw, increased penalties. Government sometimes imposes heavier penalties onsome, but turn a blind eye. For example, the prevalence of false acts, which toa large extent, are produced due to government lack of strict control. Suchimpulses this problem more serious and also leads to the local discontent. In the second place, somelaws and legal system that exist indeed on some holes can not be afforded toignore. Legislated intact laws can solve most of unmoral behavior on thecondition that anyone are not intended to impose the morality laws to anybody, because such impinge upon mankind freedom of choice and simply do not work in ademocratic society. Unfortunately, most laws being today have not been includedexplicit and special rules, or even not contain relative moral rules. Take thewaste disposal as an example, some people consider that throwing litter pick isa normal phenomenon, is likely to be because they do not have a strong moralconsciousness caused by the present law it is necessary to strengthen theirawareness, followed by the development of relevant laws. In a word, the lawsand legal system not sound are given opportunities to commit moral critics, toproduce violent results. In a nutshell, perhapssome immoral behaviors are punished according to the legislation, especially asthe nation and government continued its attention to improve the law. In the future, when moral behaviors are legislated, the society would more flourish andstable. The following appeared in a medical newsletter.“Doctors havelong suspected that secondary infections may keep some patients from healingquickly after severe muscle strain. This hypothesis has now been proved bypreliminary results of a survey of two groups of patients. The first group ofpatients, all being treated formuscle injuries by Dr. Newland, a doctor whospecializes in sports medicine, took antibioticsregularly throughout their treatment. Their recuperation time was, onaverage, 40 percent quicker than typically expected. Patients in the secondgroup, all being treated by Dr. Alton, a general physician, were given sugar pills, althoughthe patients believed they were taking antibiotics, Their average recuperationtime was not significantly reduced. Therefore, all patients who are diagnosedwith muscle strain would be well advised to take antibiotics as part of theirtreatment.提纲: 1、通过实验并不能证明,二次感染会使病人恢复变慢。2、并未排除服用其他抗生素使病人恢复更快的可能。3、strain 和 injury 不是一回事。4、参与调查的数据值得怀疑。In this argument, the arguer claims that the first group of patients treated for muscle injuriestook antibiotics regularly throughout the treatment, whereas another group ofpatients were given sugar pills. Such leads to the first group of patientshaving a quicker speed of recuperation than another group of patients. Then thearguer draws a conclusion that the secondary infections may keep some patientsfrom healing quickly after severe muscle strain. In addition, the arguer tellslittle about the statistics relative the experiment. This argument is unconvincingfor several critical flaws.First of all,by the different recuperation time of the two group of patients the arguerunfairly conclude that the secondary infections may keep some patients fromhealing quickly after severe muscle strain. The survey at most demonstratespatients taking antibiotics might have a quicker recuperation time than anothergroup. There are not enough facts to demonstrate secondly infection contributesto keep some patients from healing quickly. In addition, the arguer does not rule out the possibilities that other drugs that curepatients suffering from the muscle strain. The arguer simply cites antibioticstaken by patients, which might play more effective role in curing muscle strainthan taking sugar pills. However, the arguer might overlook the other drugscould play a higher effective part. This is also a significant pointnecessarily included. Moreover, the arguer unfairly confuses themuscle strain and muscle injuries. But in reality, the muscle injuries in mostcases probably equal to the muscle strain, the former stands a broad category. So the experiment is doubtful for the investigated statistics includingpatients of muscle injuries rather than purely muscle strain. Finally, thearguer tells little about the investigated samples in the survey such as theage and the physical conditions and so on. These are significant factors mightimpact the results. Everybody’s recuperation varies from different physicalconditions different ages and different treatment environment. If the over 60people participate the survey, it is obviously unfair to conclude the results. In sum up,the arguer must demonstrate above the doubtful issues and provide more facts tomake us believable. |
