Issue17. There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws. < society·politics>
I agree with the statement that each one in a society has a responsibility to obey laws; however, from the word go, it mistakenly classifies any law as either just or unjust. Additionally, as a matter of fact, whether we have to disobey unjust laws or not depend on the situation of history or society.
Whether a law is just or unjust is rarely a clear-cut issue. The item “just” is going to vary greatly according to different traditions, cultures, value systems and other conditions. Consider, for example, the controversial issue of euthanasia. Individuals with particular religious beliefs tend to view laws allowing a doctor to kill the patients with hopeless sick in a relatively painless way as just, whereas individuals with other value systems might view such laws as unjust. While, when it comes to the unjust law which is precisely the same. Moreover, some laws can be categorized as neither just nor unjust, which are constituted for the purpose of keeping things in order.
Even assuming that some of the laws are so-called “unfair ones”, the ways we deal with them should rely on the contexts, such as the political system of the nation, the acuteness of the conflict and so forth. In some particular situations, to disobey the unjust requirements is the most effective solution; while, there are lots of more reasonable solutions of general problems.
As everybody knows, before the Supreme Court struck down segregation in 1954, African Americans, such as Rosa Parks, could be thrown into jail and fined simply because he or she refused to give up the seat on an Alabama bus so a white man could sit down. In the very era, the concept of racial and ethnic equality has been accepted by few people, especially the privileged Caucasians. The movement led by Martin Luther King is the only solution, at that time, to deem segregation, which changed America forever. King is an individual of those who disobey and resist unjust laws successfully.
Admittedly, as discussed above, laws are sometimes created that people later recognize as being unjust or unfair. However, in democratic society, every civilian has the right to express his or her own views on laws freely, in the forms of participating Congress, making a free speech and democratic election. In most of societies like Canada, laws are not carved in stone, but must reflect the changing needs of society. And take the United State Constitution for example, which was born in 1787, has been added twenty-seven amendments, until now. It is during one year that ten amendments were added to the Constitution to ensure human rights in 1791.
To sum up, as I have discussed above, no law can be recognized absolutely just or unjust. When we find that some laws cannot protect basic rights and freedoms or treat everyone fairly any more, to disobey them is not our only choice. Instead, for most of times, we can solve them peacefully.
