180.many problems of modern society cannot be solved by laws and the legal system because moral behavior cannot be legislated.
Nowadays, many people begin to questioning the vaildity to resolve the social problems of laws and legal system, since moral behavior cannot be legislated. I agree with the explanation that it is impossible to establish a law on moral behavior, however, we should not ignore the capacity of the laws to unravel society's problems.I suggest that the we should use both ethics and laws to ensure the the development of the society.
To begin with,the law system designed to restrict our behaviors is not always a panacea, because it confines our external behaviors while have nothing to do with our inner characters which is tightly linked to moral. for example, discrimination related to gender ,age ,racial and the like as a moral behavior is a pressing society's problem. many country such as Canada ,UK have introduced some acts to prevent the invidious discriminations, however, we can easily find an aminated scene that the employer prefer a man to a woman,choose young with energy rather than a man who is over 40 ,take away opportunities cruelly from disabled during a interview. Actually moral behavior are out of the range where the laws are efficacious.
Moreover, as aspects are mountainous, it is an mission impossible for legislator to consider every respects that moral behavior refer to.Even if they merely have a try to pass an Act, it follows that the law cannot be perfect,that is to say,some illegal people would circumvent the crime of moral which in turn undermine the stablity of the society,
reversing the original intention of the law.
Besides,every individual has his or her own moral standards, thus it is insuperable to take everyone's criterion into consideration,otherwise, laws will lose its justice.
nevertheless,one must admit that the legal system of a nation establish laws and force people to conform them by punishing those who crimes, and in this way maintain the stablity of the society. in this sense ,laws have already solved many problem. for example,In order to save the lives and the propery of the students from Cumpus violence,appealing to the law is an efficient way; for the popurse that to ensure the effecient and ordered competition in the business, a law of Anti-trust is required;A drunk driver would be severely punished,so as to reduce the traffic accidents,what's more ,Because of the law
, many murders, theives, robbers and the like are imprisoned ,and common people still have a happy life with their family.
Indeed, we could employ both ethics and laws to develop a secure and steadyfast society . Moral help bulid one's value to distinguish right from wrong and then one will act self-restraint while laws restrict one's visible behavior and then one will harmonize with the society.If there were only laws,concealed crime betrayed the moral would infringe people's right,and at last,everyone will become selfish and indifferent.On the other hand,if the world is organizied without law but only moral, then the true restriction is just a fragile vase easily shattered because of the human nature such as greed. What if we utilize the both of them? I believe the society would become equal ,peaceful with fewer crime,as we have double insurance derived from inner and external.
To sum up, we have a lot problems that are pressing to resolve in today's society.though moral behavior can not be legislated ,we can try to solve them through morals formed gradually and spontaneously with the help of mores and through laws legislated to gurantee the people's right. Only through this way ,can there be a promising and prosperous future.
