ISsue17法律公正性那题！我限时写的，但是改了很久，还有四天就考试了，觉得有些焦急啊！
The author claims that we should obey the just laws and disobey and resist unjust laws , however as far as I am concerned , the threshold assumption that law can be divided into just and unjust types is quite unfair .Moreover , the assertion about obeying or disobeying laws in term of the two foregoing facets is doubtful. In addition, laws served as the ethic and philosophical principles from which require that people must not depart.

Classifying laws into the just ones and unjust ones is inapt .Laws develop as society develops. We view most of the laws such as sacrifice, in tribal society, as unjust .In the modern society, due to different occupation, religions and stand, when confronted with the same controversial issues, people evince different attitudes. Laws are also not fixed and elastic according to different cultures and countries. Monogamy, served as a law, for example, is entirely enforced in U.S, China and most of countries in the world, while it is inapt to implement in some Arabic countries. That is to
say, there is not judicial justice ,let along absolute justice ,what we in favor of is just objective justice. In short, a law implemented hardly can reach a goal that everyone feels just.


Admittedly, few laws can satisfy all people, as the body of official rules and regulations, laws serves to govern a society and control the behaviors of its members. According to the theory of Rousseau, an outstanding philosopher in France, in a democratic society which represents the general wills of its citizens, obeying laws is to pursue one’s own real interest. Thus, laws express the general will. By enforcing corresponding penalties, punishment and remedies, laws ensure the stability of the whole society and the nation. Thereupon, once the laws have been implemented, what we should do is to undertake the obligation to obey, even we might have intense disagreement to them. If one individual freely judges the laws and determines whether to follow them or not by himself, laws will lose their authority and function. It is the draconian laws and people such as Agnew, the American vice president, that keep the sublime status of laws thus keep the stability of society.

Undoubtedly, in most area of current world, laws grow in a right way to express our general will, there is some drawbacks in its systems. When it comes to that them indeed inhibit the development of society. the laws also need to be corrected. A case in point is China, along with the implementation of “reform and opening up” policy, many laws in economy can not adapt to the new market, thus a myriad of reforms in laws come into being. Moreover, as the development of science technology and the advancement of society, a myriad of new crimes come into being, if we do not amend our current constitution to take measure to these new crimes, there will be many more turmoil and chaos far beyond the crime itself. The law commission built in 1965 in England provides us a good way to solve those
foregoing problems. Within many of the functions, the most important function is to amend the drawbacks or provide new laws to adapt to the development of society and general will of civil. In short , laws should develop as the society develops.

In sum, laws should not be divided into the just ones and unjust ones for everything has two sides. In addition, in certain areas, laws must be put in the first place which everyone has not the rights to disobey. Last but not least, elastic ways should be implemented to ensure the laws always impel the development of society.
