戴尔Inspiron电脑存设计缺陷 在加拿大遭共同诉讼

美国东部时间1月15日（北京时间1月16日）据外电的最新报道称，加拿大多伦多一家名为Rochon Genova LLP的法律公司上周五在安大略省高等法院对戴尔加拿大提起共同诉讼。诉讼要求戴尔为五款存有缺陷的Inspiron系列笔记本电脑用户提供补偿。

Rochon Genova LLP在诉讼中称，戴尔“忽略了笔记本电脑的设计问题”，因此存有问题的Inspiron系列笔记本电脑可能会因为过热，而导致主板被过早破坏。诉讼还称，这一问题“往往是在戴尔产品一年的保质期结束之后变显现出来”。

原告在诉讼中称，戴尔存有缺陷的笔记本电脑包括Inspiron系列的1100，1150， 5100，5150和5160。此前，戴尔曾在美国遭遇了类似的诉讼，并最终承认其中的一款笔记本电脑存在设计缺陷问题。而其余四款笔记本电脑是否存有缺陷的诉讼目前仍在审理当中。原告称，戴尔忽略了笔记本电脑的设计缺陷，而且在知道存在问题的情况下，仍然在销售这些存有问题的笔记本电脑。

戴尔最近遭遇了一连串的挑战，先是去年在几起电脑起火事故之后被迫召回了410万块笔记本电池，从而使名誉遭受损失，最近又不得不将全球最大个人电脑制造商的桂冠拱手让给了竞争对手惠普。分析师指出，戴尔接连出现的问题正在帮助惠普和联想提高它们各自的市占率。

On January 11, 2007, Rochon Genova LLP commenced a proposed class action in the Ontario Superior Court of Justice against Dell Canada Inc. (“Dell”).

The Statement of Claim alleges that Dell was negligent in the design of the notebooks, and that Dell knew or ought to have known of the inherent defects in the notebooks' design but nevertheless sold, marketed and distributed the notebooks in Canada. As alleged in the claim, the fundamental problem with the Dell Inspiron computers involves design defects that make the computers susceptible to overheating and premature motherboard failure. The failures involving these Dell notebooks often occur outside of the warranty period.
