"There are two types of laws:just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws."

Law,body of official rules and regulations,generally found in constitutions,legislation,judicial opinions,and the like,that is used to govern a society and to control the behavior of its members. According to this statement, the speaker asserts that every individual in a society is incumbent to obey just laws and to disobey unjust laws. However,in my perspective, it is arbitrary to categorize laws as just and unjust ones. Besides every one has a responsibility to obey laws due to the significance of constancy in legal system.
To begin with, the justice of a law is more of a relative attribute that depends on one's personal stance in the legal issue. Though in a democratic society the chief function of laws is to call for fairness, it may seem unfair especially when it comes to individual rights. Consider, for example, a law that prohibits smoking in public. The non-smokers may embrace the law for a simple reason that smoking in public will make them feel uncomfortable. Whereas, for individual smokers, they may argue that it is their freedom to choose where to smoke.Thus smokers may feel that law violates their right and the law is unfair. Besides, diverges generate due to personal interest and benefit. For instance, a law regulates that all cigarette advertising is banned from radio and television. Since advertising is vital to commerce, the tobacco industry feel unfair so that they long denied that nicotine is addictive and that there is a link between smoking and poor health. Both of the two examples illustrate us in some cases, in order to assure most benefit, a law has to sacrifice minority's one.
Secondly, laws are established by legislation, which projects a nation's will. Associated with traditional mores, morality,and custom, a law is consistent with a nation's policy and situation. Consider, for example, the controversial issue abortion. For people of certain religious belief, laws indulge abortion are unjust. Whereas in China, Because of one-child policy which aims to control the population, abortion is legal,and pregnant women who already have one or more children face social and administrative pressures to terminate their pregnancies. Consequently, in some cases, a law becomes a coercive method to make sure of the stable development of a nation.
Finally, law serves a varitey of functions. Laws against crimes, help to maintain a peaceful, orderly, relatively stable society. And property and contract laws facilitate business activities and private planning. Our society cannot operate well as a systemic organization without individual obeying to law. Take gun control for example. Each year in the United States, more than 35,000 people are killed by guns. And strict gun control will reduce the number of crimes committed with guns. In order to make a society in safety and peace, everyone has a responsiblity to obey a law of gun control utterly , even if gun control laws are a bit controversial.Anther example, it is vital to not only the drivers but also passagers that drivers must obey to the law of speed limit in highway. In a word, no one has the right to disobey any law for any reason.
In sum, any law cannot be divided into just and unjust ones.In order to make a society be absent of chaos, everyone must comply with the laws. |
