The speaker asserts his statement that we have the right to obey the fair laws and fight against the unfair ones. Admittedly, I concede that the speaker stands on a correct philosophical side. After all, the fair law is worthwhile to respect and insist, whereas the unfair is harmful to our life and society, that is, every people hope to be fairly treated and hate the unfairness. However, given that certain history conditions and social and cultural backgrounds, the unfairness of various degrees exist in law, just which are always not obvious.
Law is a guarantee of the order of society and happiness of our life regardless of the fair or unfair, While the fair laws are able to play more important role to promote the development of society and economic than the unfair ones. American constitution’s basic spirit: all men are created equal, firstly gave the underlying definition of the fair law. Just such ‘equal’ ensure the democratic nation being built, the racism prejudice being eliminating, and the guilty government lead of President Nixon being forfeited leadership. Attribute to the concept of fairness, the American’s progress is up to the fight with unfairness. Moreover, by The Civil War giving the fairness the color really American became a industrious nation from a agricultural nation. So fairness is source of nation continually progress as well.
On the other hand, the unfair laws seem an enormous stone lying in the road to move forward. It not only threatens our life and hampers the development of society. Moreover, it destroyed our concept of fair, maybe which is more terrible to loss the belief and desire of fairness. When the Hitler’s government legislated to persecute the Jew, All German kept silence. As the poem write: the police come to arrest the communist, I am silence; they came to capture the Jew, I lost my voice; they came toward me, there is no voice for me. Clarence Darrow once said: As long as the world shall last there will be wrongs, if no one rebel it, those wrong would last forever. Without the Glory Revolution against the unfairness form royalty, the British may be still altogether dominated by King. Without the non non-violence and non-cooperation movement campaigned by Mahatma Gandhi against the unfairness to India people, the India might be British colony. To possess the spirit of suspecting and rebelling unfairness in laws is necessary to us.
However, what is standard to judge whether the laws is fair or unfair? From ancientry to contemporary, the absolutely fair law system, which is devoid of any mistake and flaw, never has been entrenched. In certain era, one law likely fair was always overturned by a navel and more progress law. So his or her definition of unfairness and fairness is always limited by the history situation, such as slavish society, in which there is not really equation of every people, its laws serve the slavery, any one who disobey it was doom to die. Even the great tinker and philosophist Socrates had to say: I must submit the degree of Athens.
In sum, both fairness and unfairness constitute the laws, that is, the less unfairness, the more fairness. We must continue to pursue the purpose of eliminating the unfairness in order to our better future. When we are treated by a unfair law, while we must be circumspect of the measure and form of fighting, since that might be at cost of blood and even life.
