The speaker asserts that because moral behavior can not be legislated, many problems of modern society cannot be solved by laws and the legal system. To be frank, I am (这里是不是应该删去am呢?)only partly agree with this opinion when it comes to some particular regions.
In general, no matter law or morality, the aim of them is to make a rule for people to follow and help people to live in harmony with each other. Law is a tool to restrict people's behavior so that they can not do things threatening or doing harm(改为being harmful 会更好吧) to the freedom and rights of others, they can help us to think and judge in a sensible way. Similarly, morality is used to restrict people's thought and ensure(insure好像多指保险) that they will not say and do things which will not be accepted by the society, it helps us to think(可以删掉这个think就好了) consider the feelings of others before making decisions. The biggest difference is that, they get different punishments. Anyone who breaks the law would get punished by the law, but some moral faults may not get material and physical ones, the punishment is usually the condemning of the public and themselves. However, sometimes the fault one makes is both legal and moral, then he will get punished both physically and psychologically.
In our daily life, laws and morality are both helpful for us to form a peace, harmonious society. For example, if we have conflicts with others, considering that fighting will lead to illegal behavior, we will somewhat calm down and try to negotiate with others. By communication, the problem is easier to be solved. Another example is that when Tom sees someone falling into the river and calling for help, it is not his responsibility to save the person, but moral rule forces him to try his best to save the person. We can see from the analysis that both the law and the morality is inevitable in the regular running of a society.
However, there still exist some problems which can not be solved neither by
legal nor moral. For example, the maintenance of the olds in China.(楼主想说的是赡养问题吧,但是用maintenance对吗?我也不知道) Just as described by the author, it is a problem that law can not formulate, only depending on morality seems unlikely to be solved because of the economic condition of the daughters and sons is limited. But, when we give it a second consideration, we will find that it is not a problem of the law or morality, it is a problem caused by development of society, a lack of money for people and a less of financial help by the authority. In every stage of society, some existed unsolvable problems are still inevitable, but with the advancing pace of society, they will surely be solved.
In conclusion, we should see the problems existing in an optimistic way, and have confidence that law and morality can help us to solve them in the long run.
