TOPIC: ISSUE17 - "There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws."
WORDS: 598 TIME: 上午 12:53:26 DATE: 1980-4-3
Does everybody in our society has the responsibility to obey the just laws, and is it necessary to disobey and resist the law which is pondered unjust?
In my opinion, only when we get familiar with the truthful definition of the "just laws ", can we find a way to obey them, and when the laws have several flaws or failed to work in some way, we do not inevitably need to disobey it passively and riskily or violate it on purpose.
To start with, do all the legal citizen have a truthfully standard criteria to distinguish the just laws from the unjust laws ? Obviously, The answer is no.
We usually define the "just" laws according to our own individual value systems without knowing whether this is right in a expertise circle. And if we take the this policy to define the just laws, it will be so hard to find a common definition that the world will definitely fall into a dreadful nightmare for all sorts of interests conflicts between individuals and groups or even nations.
Then what is just laws and unjust laws as a whole? Considering from a whole perspective, just laws mean to keep the society peaceful, steady, prosperous, and to ensure every member in it the basic rights to live, talk, discuss freely in democratic society. When we think of the question in our own views, we can see if our own speeches or behaviors have prevented others to gain their basic rights according to the just laws. In that way, we can move on as a whole without fighting each other endlessly.
What's more, when the laws have flaws or failed to work, we do not necessarily need to disobey it passively or violate it on purpose, instead, we can do it in a more efficient and peaceful approach. Black Americans, for example, when been divested some significant rights , they use nonviolent methods such as the opposition campaigns and big pageants to suggest the authorities that they want a change through a nonviolent way, and ultimately, they made it. On the contrary, if we deal with the "unjust laws" by the means of violating or resisting, common sense tells us that it seldom works, and what's worse, if we just keep breaking the "unjust laws" without knowing whether we are wrong or right ourselves, everybody can make several law-break cases every day , in that case, i do not think the law can function well to order the society any more, it will function as a catalys to demagogue the people and disorder the society.
Admittedly, there is no perpetually prefect constitution, which means that a really just laws should change according to the specific times, spaces and
situations. And to the authorities, it is extremely important to keep open to all kinds of advices from the people , and make the necessarily truthful amendments in time. Only in that way, people in that time will support their authority and keep the whole society peaceful. Otherwise, the people can decide which authority has the ability to lead them to the prosperity. The authority's break down is inevitable.
In conclusion, to reach a harmonic and peaceful society with a prosperous future, the people need to get acquainted with the meanings of the just laws at the contemporary time , keep an eye on their government and give their advices accordingly; to the authorities, they always need to keep an open minds to the
advices of the people and make the necessary modification of the laws in the right time and situations. |
