TOPIC: ISSUE17 - "There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws."

WORDS: 686          TIME: 00:45:00          DATE: 2008-4-14 10:53:27

Whether a law is just or unjust is not an easy issue for us to discuss. The statement confirms that every individual has the right to both obey just laws and disobey unjust laws. But I think we can not divide laws into these two kinds simply. In my point of view, many laws can only satisfy a part of people and determine the right of the other groups at the same time. It is not weird to see many people in the United States welcome a new law which has just been passed by congress and another group of people disapprove it severely. And sometimes, people even do not have the right information to judge if a law is just to them or not. Then, I can discuss my view respectively.
Many laws are beneficial to some people as well as detrimental to other groups of people. That is to say, if a law is just or not is a relative question. This is very obvious in commerce field. For instance, the anti-monopoly law has hurt the right of Microsoft, the world's biggest software manufacturer, but it can provide more opportunities to small software makers. Microsoft bond its own software Internet explorer to his own operating system software Windows, and provided the Internet explorer to its customs for free. This commercial action disobeyed the the anti-monopoly law because other small software makers can not develop and sell their explorers to gain profit in this case. So small companies will certainly protest the unjust commercial action and prosecute Microsoft. Then, the anti-monopoly law will be beneficial to these small companies but be harmful to Microsoft. What about the normal customer? They concern only the price and quality of a software product. It is sure that Microsoft has the right ability to provide cheapest softwares with highest quality. Thus the anti-monopoly will certainly hurt the right of normal customers for a certain time. In this example, we can see that the anti-monopoly law is beneficial to small companies and normal customers, but detrimental to Microsoft. We can make the conclusion that whether a law is just or unjust is a relative.
Sometimes, people can be misled by government of media and they will lose their abilities to judge if a law is beneficial to them or not. For example, American troops have broken the old order in Iraq and sent the dictator Sadam to death. Those Americans also legislated for Iraqi people in the name of constructing democracy. But these laws may contain the United States' own benefits in it. If Iraqi people believe the new law which has been constructed by the Americans, they will lose the ability to pick out the laws which can do harm to their right. In this case, people should not obey or disobey laws blindly, they should have their own views to judge among them.
Of course, any country should provide the right to normal people for them to judge and obey or disobey laws. The final aim of laws is to construct a stable society which is suitable for development and to satisfy the majority of those people by providing what they needs. Thus, to give the right to normal people to obey and disobey laws freely is essential for lawmakers to decide if laws is proper or not. If a country do not offer this fundamental right to people, the spirit of laws will not be fulfilled and failure of government will surly come. We can concern Soviet. This former super country do not provide the basical right to their people for them to obey or disobey laws freely, so many bad actions have been taken by the government and they led the whole nation to the end of disintegration. Then we can see that to obey of disobey laws freely of normal people is essential for a country and for those people themselves.
Given the discussion above, the statement has rightly affirmed the the basical ability for normal people to obey or disobey laws. But it has absolutely  divided laws into two opposite parts, which is unreasonable.
