[MA Bar] Advanced Determination on Education小结

1. 在开始之前

可能楼主思路清奇，在麻省读LLM，就只想考MA Bar。论坛上关于MA Bar的资料是在太少，今天特地来分享一下。

入门

1.1 一个基本问题

一个基本问题是——外国律师能否在MA执业？2010年MA对Rule of Board of Bar Examiners 进行了修订，允许外国律师在MA执业。这也提醒了那些想要在非热门地区考当地Bar的同志，申请学校的时候一定要注意查看这类信息。比如，CT是在不久前允许外国律师在当地执业的。

1.2 什么是Advanced Determination on Education

本帖主要介绍Advanced Determination on Education，即外国申请者报名MA Bar Exam的前置条件（注：楼主只讨论Admission by Exam； Admission on Motion不予讨论）。与NY Bar类似，MA Bar的外国申请者必须通过Board of Bar Examiners（BBE）的Advanced Determination on Education审核。

1.3 适用的规定

本帖主要涉及的规定是BBE的“Rule VI. Foreign Law School Graduates.”

1.4 大陆法系 v. 英美法系

Rule VI 区分了大陆法系毕业生和英美法系毕业生。考虑到大部分人都是大陆法系毕业的，这里略去关于英美法系毕业生的规定，有兴趣的可以自行查询——嗯，审核条件要比大陆法系宽松。

1.5 截止时间

根据Rule VI.2，外国申请人应在正式报名截止日期前至少四个月提交Advanced Determination on Education的申请。比起NY Bar来说，相对宽松一些。

2. 材料篇

Rule VI.2中详细规定了需要提交的材料:

Except for those qualified by VI.7, at least four months prior to making application all foreign educated attorneys who wish to obtain a determination of their eligibility to apply for admission either by exam or admission on motion in Massachusetts must submit a cover letter that describes the action sought from the Board, the reason for the request, and the following documentation.

2.1 Cover Letter

第一段话里提到了Cover Letter，相应的的解释是

that describes the action sought from the Board, the reason for the request, and the following documentation.

Cover Letter不难准备，笔者这里贴出一份BU的模版供大家参考。

关于“following documentation”，咱们一条一条地说。

2.2 Official Transcripts

先看Rule VI.2的解释：

An official transcript from every college, university and law school (foreign or American) attended; this must include the courses taken, the grade for each course, the degree and date awarded, and the dates of attendance;

这条规定在总体上与在申请LLM时提交给LSAC的一致。对于法本毕业的LLM的申请者来说，需要提交的是本科的成绩单；对法硕毕业的LLM来说，需要提交的是本科和硕士的成绩单。

值得一提的是，与NY Bar不同，递交给BBE的外国学校成绩单无须密封，也无须从外国学校寄出。官方FAQs的说法是

The official transcript from the school can be open and attached to the documentation.

这条规定也存在一个问题，即加粗的部分：作为正在美国法学院读书的LLM，我是否需要提交LLM的Official Transcripts？官方没有给出说法。一种非官方解读是，即使刚选完课，申请人也应该立即提交一份没有成绩的Official Transcripts。具体的内容如下

Immediately after registering for classes in your LLM program, you must submit to the BBE an Initial LLM Official Transcript certifying your enrollment in an LLM program at an ABA-approved law school, and listing your enrolled courses for the fall and spring semesters. You should submit the Initial LLM Official Transcript as early as possible, even if you have not received any grades yet, and even if it is significantly earlier than four months prior to the application deadline. You should try to do this immediately after the add/drop period ends, or as soon as you are settled in your classes, whichever is earlier.

楼主在2017年10月中旬通过本校的LLM Director联系了BBE的工作人员，得到的答复是：Initial LLM Official Transcript的确需要提交，但只需要在秋季课程结束，有了成绩以后再提交。此为最新的非正式解释，供大家参考。

2.3 Diploma

Rule VI.2中对Diploma的解释是：

Copies of all diplomas or degree certificates.

这一条想必不需要笔者多费笔墨。唯一值得注意的是，Diploma和Degree在BBE眼里是不同的东西，还请大家开证明的时候不要搞错。

2.4 Course Description

Rule VI.2中对Course Description的解释是：

Descriptions of all courses, if not included in the transcripts, along with the method of study, i.e. classroom or long distance learning, etc.

这条可得好好讲一讲。

首先，不是所有的外国学校都有英文的课程说明。根据Rule VI.2 “…the following documents written in or translated into English,” 可能要辛苦大家自己翻译一下了。楼主这里贴出一个模版供大家参考。

其次，不是所有的外国学校都有课程说明。笔者恰好碰到这个棘手的问题——学校的确有课程方面的信息，但不完全符合Course Description的要求。先看官方的FAQs:

Any documentation produced by the school that describes the content and subject matter covered by each course, such as a course catalogue, syllabus, or other description produced by the school, is acceptable.

根据官方的说法，这时候只能拜托学校出具符合要求的Course Description并加盖校教务处的章。关于院教务办的章是否符合条件，笔者没有进行尝试，建议不要冒此风险。

再次，“Descriptions of all courses” 而不仅仅是法学相关的课程。这意味着没有课程说明的申请者需要准备的内容又多了一些。

最后，细心的读者可能发现该规定存在例外，即“if not included in the transcripts”。如果Course Description已经在Official Transcripts中体现了，是不是就不用提交Course Description了呢？笔者不能肯定。因为Course Description的原文中“method of study”是“along with” the descriptions的。所以，笔者推荐申请者单独准备一份Course Description。

顺便一提，BBE设置本条的目的是确认申请者是否是真正的法学毕业生。NY Bar也有类似的规定，申请者的法学类学分必须达到一定标准才被视为是法学毕业生。因此，那些辅修法学的申请者要做好与BBE argue的准备。

2.5 Certificate(s) of Admission

这条也大有讲究。先看原文：

An official Certificate of Admission and Certificate of Good Standing from each jurisdiction to which the attorney is admitted.

此条款要求申请者提交两样材料：An official Certificate of Admission和Certificate of Good Standing，缺一不可。这也表明MA Bar要求申请人必须be admitted to practice law。相比之下，NY Bar的Rule为申请者提供了§ 520.6(b)(1)或§ 520.6(b)(2)的选择，较为宽松。

由于中美对practice law的理解存在差异，Certificate(s) of Admission条款在适用时变得有些不确定。在美国，只有律师可以practice law，从通过当地司考到成为律师，是一步到位的事情。中国的情况则不同：通过国家司法考试并取得法律从业资格证，实习一年考核通过后方可成为律师。考虑到这种断层现象，那些取得法律从业资格证，但没有律师证的申请者就遇到了问题：
他们到底算不算be admitted to practice law? 如果是，他们无法提交Certificate of Good Standing（一般由当地律协开局）；如果不是，他们由于没有满足Rule VI.2的条件，无缘MA Bar Exam。

不幸的是，笔者属于此类申请者。坊间有“挂证”的做法，笔者不予评论。以下是笔者的解决办法：1. 将法律从业资格证翻译、公证；2. 让当地司法局出具Certificate of Good Standing。前者比较简单，后者有一定难度。笔者建议大家先做好模版，并在字词上多多用心，既减少司法局在盖章时的忧虑，又满足BBE对Certificate of Good Standing的理解。笔者附上一份自己的模版，供大家参考。

2.6 Resume

Rule VI.2中对Resume的解释是：

A resume detailing work history.

此条按字面意思理解即可。
