Congrats on your admission to selective JD program in Hong Kong, the principal purpose of this abbreviated note is to share my honest thoughts with you about the pros and cons of choosing to engage in a law qualifying degree in Hong Kong or like jurisdiction. This note is drafted primarily with mainland LLB graduand in mind, therefore,if your background substantively diverges, it probably would not be a apposite piece of advice for you.
The first practical and sensible question which you will naturally confront is:"Will I be able to land a job as solicitor or barrister in Hong Kong after having embarked on years of lengthy and highly expensive JD+PCLL+Training Contract/Pupillage ritual?
My apology to set our my message with a potentially negative overtone. There is no shortage of qualified legal professional in Hong Kong, yeah, it's wonderful to envision a wonderful and decent career await you when you when you have the first opportunity to complete a JD program, I think it pays for you to include some risk factors into your current planning and decision, this is of paramount importance in getting where you want to reach eventually.
Let us know our composite strength and weakness, for student originating from mainland with previous educational background in civil law bloodline, you would definitely be competitive in HK job marketplace, if you can produce tangible benefits for the firms, to help them woo mainland related business or take care of their highly prestigious and high net workth clients based on mainland, mainly those big shots with typical shrewd Chinese businessman mindset,to be able to communicate with their mainland clients without any encumbrance in all form.
Let us boldly face the crude reality, not great many of graduates of mainland background will be able to gain quick offer from local law firms, this is probably attributable to our cultural, linguistic and other cognate barriers, for students with intimate Hong Kong connection, they usually will have an unbeatable edge in ferocious contest for limited job offer from high-paying law firms, there is no doubt, I am not blatantly ignorant of the fact that we have quite a number of high-caliber and top performing graduates of purely mainland origin, unfortunately, at this point of time, people of Hong Kong descent/link (those born in HK/abroad of Chinese ancestry, properly educated overseas for their high school and college etc) seem to get a salient headstart in their JD studies, summer internship search and post graduation employment opportunity.I think they derive a significant advantage from high English competence and thorough familiarity of western culture, practice and traditions, as we are fully aware, common law ultimately embodies the tradition, customs and practices of the Anglo-American world.More importantly, employer hire people who can network with their clients on the same plane, preferrably with some shared value and experience.
This introductory note does not serve to discourage you from taking JD program, I just want to urge you to be mindful and vigilant of various scenarios which might happen to you either during study or after completion of it,thus you can think of different career paths and options in the process of undertaking JD program, I hope you can be proactive in your career mapping, which should be carried out sufficiently in advance, with an open and practical mind.
If I have time, I will continue to flesh out my thoughts on doing legal professional qualification in HK. I hope this is the first installment ,not the only and last one.
Good luck and best wishes with your academic endeavor ahead! |
