Issue 17
There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws.
In my response to this issue I found this assertion is too vague as it presented because the assertion fails to give definite definition in just laws and unjust laws. Moreover, even though laws can be distinguished by just and unjust, is it means that we can choose obey these just laws and disobey these unjust ones? I highly suspect the assertion that only just laws should be obeyed while unjust laws should be disobeyed. In my perspective I don’t agree with the assertion, on the contrary I think laws should be obeyed and we should make a compromise between so called just and unjust laws.
Before I present my statement I would like to clarify what just laws and unjust laws are. Laws which are enacted by those in power serve to maintain the stability of the society as well as the whole nation by punish those who disobey it and praise those who advocate it are the codify regulation to all the citizens. In another word, laws sever to protect the interesting of those in power and the interesting of public. Different people may hold different views to certain laws because of their different backgrounds social status and personal value systems. For example, the rich may think that the investments in improving the poor's living condition is useless and meaningless, on the other hand the poor may think those laws which give priority and privilege to those in power is unfair. Every person has his or her own perspective to those laws as mentioned above. Consequently, the division of laws of just and unjust sometimes is too vague and lacks uniformed standards.
Despite this dispute in classify of laws into just and unjust, it is everyone's duty to obey these laws, though some of them may have different or even hostile evaluation on them. If everyone challenge the laws which they considered unjust, our society will slip into chaos and laws lose its power in maintaining the stability and regulating citizens, thus making more damage to welfare of the whole society as well as everyone's interesting. Imagine that if everyone chooses to disobey the laws that they considered unjust, we will witness continual conflicts among different classes, and the nation is vulnerable to be attacked or even collapse. Take former Soviet as an example, the newly established policy in reform undermined the nation’s foundation, and most provinces refused to these changes making Soviet, once largest and most powerful nation in the world break into pieces. As a result the living standard of the whole nation slip down, overwhelming citizens became bankrupt, and many people have to face starvation due to the decrease of their income and the economic crisis followed. This is not only a disaster to a certain country but a disaster to all the citizens in the nations including the rich and the poor. This may be an extreme example, but unfortunately, it does exist. From this reason I talked above, obeying laws is everyone's responsibility and disobeying it may cause painful disasters.
However, we cannot deny the fact that sometimes the law is not desirable, and even rigid. Because these laws may undermine the welfare of whole society and even retard the progress of whole country. This kind of situations does exist. But just by disobey it I think it cannot solve this problem. I believe that every democratic nation will function well in cope with these situations. Because if a law is thought unjust by most of populace is highly like that this law is no longer suitable and even wrong. In this case, government should take action to modify this law and make change on it. Government should listen to the populace’s voice. Laws are not only a regulation in our everyday life but also a spirit of the nation. Without convey the citizen's inclination and spirit the law cannot be obeyed voluntary or esteemed by citizens. Thus, to make a law more convincing and more effective it is important for government to communicate with populace in a variety ways, such as build up a community aim at listening and evaluating people's idea.
In sum, we cannot define just laws and unjust laws by our own will, because different people have different values on them. Moreover it is every citizen's duty in obeying laws. If we consider the law as unjust, we should show our perspective by legal means not to disobey it. As government, it is government duty to strike a balance between just and unjust laws. Before any judgment make, it is necessary to hear populace’s voice and communicate with citizens, because citizens are the foundation of the whole society, thus their opinion should be valued.
