180. Many problems of modern society cannot be solved by laws and the legal system because moral behavior cannot be legislated.
开头：同意
Laws and legal system are built on the bottom line of moral, in order to prevent from and punish the behaviors which seriously surpass the moral, such as murdering and rubbery. I totally agree with the speaker that many problems of modern society-in fact not only modern society, but also in the past and future-cannot be evaluated by laws and the legal system because moral behavior cannot be legislated.
论点1. 定义moral behavior
In order to be aware of this statement, we should firstly catch the definition of moral behavior. In my understanding, it stands on people’s religion, belief, ideology and even prejudice, ignorance and hatred. When a behavior is considered as moral, it reaches the expectation for good, even adorable, always over the obligation.
论点2. 法律的职责范围决定了它的局限性
The second definition is about law. It is designed by bottom line of social moral, with the start point from evil intrinsic humanity, extrinsically legislates the social behavior in a passive way. For example, in any country, if there is a police-like-man bulling a little girl, according to the law, passers or onlookers have no responsibilities to save the girl.
Since here, we fundamentally understand why laws cannot restrain the moral behavior: the law does not encourage the moral behavior, so does not punish the people who is lacking of moral behavior. The only duty of the law is preventing people from committing anti-moral behavior. Then comes a question: what cause the limitation of function of law?
追溯源头，是国家制定法律的意图决定了法律cannot legislate moral behavior
Stand in whole country’s perspective, the essential intention of laws and legislation system is protecting the interests of region's of people and keeping normal operation of the country by organ of violence such as army, police and city inspectors. The higher moral the law legislate, the more expense the country will cost, and the more serious conflict among people with different moral value would be stimulated. So the present law balances the cost of maintenance and the necessary moral which promise the normal operation of the country. In other words, the behavior which is lower than the bottom line of the moral will obstacle or damage the country's operation, however, behaviors which neither reach the adorable behavior nor surpass the moral bottom line, both law and country would not regard them as problems.
论点3. 有时候道德本身对道德行为都无法公正评价，更何况法律
Another reason for law's inability to legislate moral behavior is that the definition of moral behavior itself is ambiguous sometimes. Here is an assumed scene: a truck was out of control and directly rushed to five people, stood by and a stout person was behind him. At that time he had a choice: push the fatty to the truck, so the truck could be forced to stop. As a result, the innocent five would be saved by an innocent one. Is this choice a moral one? As a controversial behavior, in spite of five people’s life is obviously more valuable than one in quantity, but in most countries, the court will sentence the people who save the five by saying that no people have the right to choose others’ lives, and murder, absolutely, is crime. May the sentence be alleviated in some degree, however, in angle of the moral, it is still not a fair judgment, since the moral cannot offer a fair judgment for moral behavior itself.
总结
In sum, a killer is an evil, but one who does not kill is not certainly an angel. The law just prevents people from becoming an evil, but does not conduct people to be an angel. It is moral’s duty to nurture angels for society.
