180."Many problems of modern society cannot be solved by laws and the legal system because moral behavior cannot be legislated."
1. 同意. 社会的发展过程中问题不断地出现,只有解决问题才能把人类社会推向进步,然而有些问题能够解决,有些问题不能。
2.确实,当今世界上的问题有很多种,有一些是长远问题,比如教育,环境,核武器等等。有一些是当务之急,比如疾病。有一些问题不能被立即解决,有一些问题能够放长线掉大鱼,而有一些问题是根本没办法解决的。问题的种类有方方面面,有的可以用法律来约束,而有的有不能用法律来约束,比如道德伦理问题。
3.法律的作用。法律就是为了解决问题。法律能够帮助解决社会上很多很多问题而得到大多数人的赞同。然而社会上的问题太复杂太层出不穷,法律根本不完善,而且每个地方的法律不一样。法律通常是富有争议的。比如枪支的使用,安乐死,堕胎。
4.道德,道德和伦理是人心里最深的防线,人之所以为人,就是因为有这些的约束。而当问题是涉及到道德伦理方面的时候法律显得非常脆弱。比如同性恋婚姻,艾滋等等。
5.所以说问题的解决需要方方面面的努力,在这个社会要尽可能地遵守法律,而同时在看待问题的时候要摸摸自己的道德底线,不要越过雷池。
Since the outbreak of industrial revolution, science and technology sprung up like mushrooms, which led to a soaring flourish in the areas of economy, politics, and culture. However, behind the prosperity of the whole world, reveals numberless of problems. Some of them are long-standing, while the others are just cut a figure. It is no doubt that only continuously struggling on these problems can we promote the progress of the whole society. That is why the legal systems and laws occur. They acted as ways to solve the social problems, punishing and admonishing the criminal behavior and preventing the dangers from happening. Yet, are them capable enough to solve all the problems and convincing all the people? Fundamentally, yes. Whereas, we cannot negate the fact that sometimes laws are not panacea, especially when encountering with moral and ethical related problems.
There exist millions of issues in the world. They can be divided as long-term issues like racial discrimination, environmental pollution, and nuclear weapons, and immediate problems such as diseases, wars, and education. Millions of people are dedicated to work all the things out yet some of them are still up in the air. For the long term issues, laws and legal systems may work at some point, but it can not cover all the problems. After all, they are legislated based on the previous experiences and criminals, which aptly expresses the omissions that new problems come out without appropriate solutions for them. Let’s take the gun policy as an example. At some places, firearms bargains are prohibited by law while in other places are not, this is where the controversy exists. The comment of both the pros and cons seem reasonable. Nevertheless unfortunately the correct decision is hardly to be made as there are no lessons drawn from the precedents. For the short-term issues like diseases, laws always play an important role. We cannot imagine that without the laws and orders, what the society would be like. Problems continue emerging, revealing to be complex and intricate. Laws and legal systems are not consummate enough to make everything perfect and satisfying, omissions are always exist, especially when some problems related morality and ethics.
As is known to us all, morality and ethics are the bottom line of human behavior. It refers to personal and cultural values, codes of behavior, and mores that distinguish between the right and wrong in the human society. It stands as the most manifest character of human beings compared to other creatures. In our society, problems related to morality and ethics emerge one after another such as the AIDS, the homosexual marriage, racial discrimination, wildlife conservation, etc. Our laws and legal systems become vulnerable when morality and ethics are involved in problems that needed to be solved. For example, laws about inhibit induced abortion is controversial all the time as pros hold the opinion that the unborn lives deserves the right to be live on the earth, while the cons believe that a larger population can not improve the life quality but aggravate the burden of taxpayers. Just because of the varies opinions from different people, there accumulated such problems are a great many.
All of them are beyond the power of laws and legislated systems.
Yet, although our laws and legal systems are not mature enough, as a part of the society, we should obey the rules as far as possible because without the constraint of the laws, we may live under the violence and phobias. Laws and legal systems make our life safer and more splendid. In the meantime, we should acquaint ourselves the bottom line of morality and ethics, especially when encountered related problems which cannot be legislated by the law.
