17 "There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws."
有两种法律:公平的和不公平的。社会中的每个人都应该遵守公平的法律,更重要的是,应该不遵守或者违抗不公平的法律
The law, to me, means a criterion of the society, a regulation in daily life. People lives in the same society, a norm, guarantee the safety and right of everyone, is needed to regulate their behaviors. The law is also the product of interest-balancing of each stratum that protects each person’s benefit.
The definition of just laws is the ones that protecting most people’s interest without harms to the vulnerable group. In that way, just laws should definitely be obeyed in order to assure that everyone is protected in the society and can be indemnified when his rights get harmed.
While the definition of unjust laws is not that clear, people have different thoughts towards that. If the law will not protect the interest of them, it is unjust to them. The nature of human is selfish; it is not hard to understand. For example: Blacks were banned to be in the same school with the white kids in early America, it was unjust to the blacks, while the whites thought oppositely. When a car crash on the person who dies after the hit, the driver have to take the responsibility more or less no matter whose fault it was. It may seem unfair to the driver but that is the law.
To maintain the development of the society and make the society better for people to live, we should obey just laws. But if making the society better is also the goal of disobeying and resisting unjust laws, the fact may turn out to be opposite.
If anyone can disobey any laws he or she feel unjust, the world will become a total mass. Drivers who run in pedestrians can refuse to take responsibility by asserting that it was the footman’s fault. People with no conscience will refuse to feed their old parents. Traffickers will take granted that what they are doing is just business. Few laws can take effect if people can choose to obey and disobey whatever they want.
The situation can get more complicated if laws are resisted by anyone who thinks it is unjust. Not only chaos but also conflicts that will happen. People in the resistance will probably go for a march without working or studying regularly, or join some illegal communities to be dolls of someone with evil intentions. Let alone the influents of bloody conflicts in all resistances, like Red Shirt Army in Thailand, that prevent people from normal daily life, only the chaos that caused by the people who fight for unjust laws can easily destroy the system of regulations in our society. If resisting unjust laws just result in confusion, whether it is right worth considering.
In the purpose of making everyone in the society feel respected and protected, laws have to be enough powerful and of absolute right to regulate people’s behaviors. We cannot choose to obey or disobey laws which we consider them to be just or unjust for the purpose of maintaining the norms of the society. As laws are not static, they are changing from decades to decades to meet the needs of people and to balance interests in each stratum. Apart from disobeying and resisting, there are still some other ways to make laws Consummate.
