"Many problems of modern society cannot be solved by laws and the legal system because moral behavior cannot be legislated.


Moral and Legalization

Are laws that legislated moral ineffective, as the speaker asserts? Basically speaking, I agree that laws involving moral can do little in solving practical problems.
Admittedly, it is possible for lawmakers to turn any disciplines into laws, as long as they follow a certain, normal process of legislation. But whether they can be really effective as governors expect depends upon what kind of moral that laws forces people to obey.
Moral principles belong to the first kind are often not only universally accepted but also basic and necessary for the society's smooth functioning. which can be, and some of them have already been, defined in form of law. These can be, and some of them have already been, defined in form of laws. For example, we are not supposed to damage the security of others' life and processions when pursuit our own; we must pay our bills; and we are forbidden from abusing women and children. This kind of moral requirements is the bottom line of laws and it is indeed effective.
However, when it comes to the second kind—the higher ones, laws are becoming nothing but ineffective. This is especial true in the case of Prohibition of alcohol, or we call it the Dry Law. Instead of leading to the expected result, the Prohibition brought serious social problems to American society. It simply couldn’t help people get rid of the desire and needs for alcohol. And meanwhile the formal market is prohibited, the black one developed rapidly, for the simple reason that illegal production trade of alcohol enabled those alcohol sellers make huge profit. What’s worse, the prohibition fostered the underworld. After the law being carried out, the underworld,
forced by the interests, upsurged in America


Another example which will illustrate this point involves drug. Nowadays most governments of the world choose to illegalize drugs. But does the prohibition actually prevent people from drugs? The answer is
negative. Actually, the prohibition not only fails to eradicate the phenomenon of drug taking, but also stimulated the Mafia market about drug. Motivated by interests, drug pushers are willing to risk their lives to smuggling drug. Apart from the smuggling, the prohibition also cost a lot of money in building drug rehabilitation center and jails.


Consequently, considering analysis and examples mentioned above, we may safely draw the conclusion that although our legal system can define some basic aspects of moral, it becomes rather ineffective when the lawmakers try to force people to follow higher-moral principles. In my opinion, in order to make the whole society get rid of immoral behaviors, the most helpful way is to deglamorize them, but not to illegalize them.
