17.There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws."

With the ever-increasing awareness of law, an issue that whether should individuals obey just laws and disobey “unjust laws” has arrested people’s eyeball. While the issue above might be a complex and controversial one, individuals should obey the laws enacted by the government or other departments with authority.
As a matter of fact, a law appears to be just for some individuals, however, unjust to other individuals relatively to one another, and even to an extent that they could be interchanged in some cases, since laws represent the interests of the majority individuals or certain groups of a given society. Obviously, those who are members of the majority or in the groups would fell the laws just, while contrary to those individuals above, others might fell a sense of unjust about the laws if the laws run contrary to their interests. Thus, the definition of unjust laws comes into being. Consider, for instance, a law aiming at regulating the toxic effluents emitted into the surroundings by some factories. Evidently, the law is designed chiefly to protect the environment and the public health, and thus the laws are welcomed by those whose interests-maybe their health-are guaranteed. However, the factories would fell unjust towards the law since complying with the law means increasing the costs, accordingly, the amount of money that could be distributed or invested is decreased. This could well illustrate the point that the laws inherently do not characterize just or unjust, it is people with different interests and thus with different attitudes towards the laws that generate it.
So obeying the laws enacted by the authorities is necessary and undoubted, without any exception for those who hold such view that the laws might be unjust for them. The purpose of laws is to regulate individual’s behavior to ensure that the society is on a path of healthy development and advancement. And the goal could not be achieved automatically unless and until the laws are enforced. Consequently, the unjust character might be generated by those whose interests or behaviors are limited by laws. Contrary to sympathize or tolerate them, punishment should be employed to those who disobey the laws without any mercy. Take the factories above for example, obeying the law and responsible for the individual’s health and the development of society are their duties that should not be shirked. The development of those factories should not base their development at the expense of public’s health. That’s the duty of factories, whether they like or dislike, and the duty for the government is to ensure the laws obeyed smoothly.
On the other hand, individuals should be offered some say in aspect of the law, and the administrators in charge of the affairs should hear the voice coming from the public as well since no thing is perfect after all. And by doing so, useful proposals, which might contribute to the achievement of democracy and the construction of legal system, might be selected. Attention should be paid to where the voice of unjust comes from to ensure whether there really exist some unreasonable or unfair things. If and only we could always do this, thus the real democracy might be mentioned.
In sum, the conception of just and unjust is really a fiction since the laws might be born of representing the interests of the majority. And it is necessary for individuals to obey the laws, and no use complaining the laws are unjust to you since the problems might lie in yourselves. |
