Issue174 Laws should not be rigid or fixed. Instead, they should be flexible enough to take account of various circumstances, times, and places.
With the development of society and improvement of living conditions, people possess different realizations and demands of laws in different periods. In fact, like author mentioned, laws should not be rigid or fixed.这句话可以不要 Laws should be changed correspondingly with various circumstances, times and places.
First of all, the definition of laws 改为law is necessary for us to start a full discussion. As we know, laws are the rules of conduct of any organized societies, which can punish the guilt by nonviolent methods to maintain an ordered society. In the different times, circumstances and places, we must obey the current laws. 觉得current用的不好。你前面说different times,如果是在古代,怎么遵守现在的法律呢?并且这句话放在这段的最后是不是好些?There is no doubt that there are a multitude of differences between laws of ancient time and modern time as well as between the Chinese laws and American laws. It is because laws are flexible enough to follow with special characteristics and demands of the society, countries and human being.
Why can not the laws be rigid and fixed rather than flexible? The fist reason is that there are different new conflicts appeared in the different time, and old laws are outdated. For example, with the quickening pace of modern technology, Internet plays an important role in the society. People can take advantage of Internet to do the international business, to have a chat with other people far away from them. At the same time, people can also take use of it to do the guilty behaviors which can damage the stability of the society, such as to steal secret data and information from government, and to publicize the violent and sexual images to the young children. Thus, in order to punish such behaviors, in the present, the law makers have to create new law to avoid those evils. However, in the past, these evil behaviors could not be conducted since there was not Internet, so there was not such law at that time. Besides laws on the Internet, there are some other kinds of new laws instituted in the present, such as marriage laws, the laws of the rights on the women and children, and legal marriage between homosexual persons in some places and so on. Meanwhile, some old laws are never fit of the modern society and never can function to maintain the stable society such as the laws on the slave. Nowadays, there is no more slavery, so such outdated laws can be eliminated too. Therefore, in order for new appearing conflicts and guilty and outdated and improper laws, the flexible laws are needed. 你举的例子不能完全你的第一个理由啊。你第一个理由说因为有不同的矛盾,所以法律不同。比如互联网的例子说明的应该是犯罪手段的不同。婚姻法的出现应该是观念的转变,家庭的矛盾一直就存在着。看看怎么把第一个理由再组织一下。
The second reason is that the laws should be changed according to different served people by laws and those people special willing. For example, compared with the ancient time and modern time, the former one is the autocratic society, and the latter one is the democratic society. Thus, the former laws served for the minority such as governors and the aristocrat, which are different from the latter laws serving for the common people. Meanwhile, for modern laws, although the laws represent common people's willing, because people's willing is unique on the different periods, the laws are still not constant too. Take the environmental law as an example. In the early period, people put their most attention on the economic development, so they ignored to maintain the healthy natural environments. However, when they begin to realize the worse and worse living environments, their will shifted to protect natural environment, thus, such laws are created by makers. Therefore, the laws should not be constant in the various circumstances, times and places. 感觉这段的层次也不是很清楚。你第二个理由是由于掌权者和人民的意志不同,所以法律不同。但是在掌权者方面,你并没有分析的很透彻,也没举出太有力的例证。看看能不能拆成两段来写。尽量写一方面,就分析的详实,而且层次感也明确。
In addition, I think that it is not important for the public to talk about whether the laws are flexible but how the laws are changed. In other words, though the laws can be newly instituted, the basis of the laws should be unchanged, such as the fairness, democracy, justice of the laws. Meanwhile, in the democratic society, making a law is not determined solely by the governors and some professional persons rather than by collecting and considering about the will of people, as well as the instituting processes should be just and democratic.
In conclusion, because of different demands on the laws from the different people, places, times and societies, the just laws should be flexible. 结尾比较仓促。是不是可以和倒数第二段合起来?
