Issue 17   What should people do facing just and unjust laws.
I fundamentally agree with the author's assertion that making change to unjust laws is more important than merely obeying just laws. However, two specious claim are involved in the assertion. Firstly, it is an arbitrary division that laws are separated into just and unjust. Secondly, disobeying and resisting may be not the accurate action to unjust laws, at least should not be put to the first position.

The dividing of laws into just and unjust ones are partial and sometimes will miss the real function of laws. Law, body of official rules and regulations, is used to govern a society and to control the behavior of its members in order to ensure a safe and peaceful society. In fact, some laws seem to be unjust but are play an dominant role in the development of society. Consider the individual tax law, for instance, it is the common sense that tax rate on the high-income individual are much higher than tax on the low-income individual. Obviously, this law is unjust to the high-income group which earn their income in a legal way because by no means they should necessarily take more responsibility for the country than the low-income groups. However, this law play a crucial role in lessoning the gap between the two groups and promoting the harmony society.

Obeying the just laws is the duty of every citizen and is also the prerequisite of preserving the stability of society. We obey laws not only because we afraid of the punishment along with the violation of laws, but also because we are desire for a peaceful and stable society which is the insurance of people's daily happy lives. In the history, we can see the prosperous country due to the obeying to the justice laws of most of the people, and we can also see the violation and bloody conflict because of against the laws. Further more, by pondering over the nature of law, such as against crimes, facilitating business activities and private planning, limiting the powers of government and providing some degree of freedom that would not otherwise be possible, we can come to the conclusion that it is relate to ourselves benefit that obeying the laws, because most laws are really basing on the just need and requirement of us.

Facing the laws that disturbing the peace of society or encroach the individual's right and wealth, people should take the responsibility to point them out and seeking for solution. Every law system will have their deficiency and limitation because of the change of people's moral principle and value along with time passing by. In a democratic society like Canada, laws are not carved in stone, but must reflect the changing needs of society. Consequently, anyone who feels that a particular law is flawed should speak out publicly and to seek to change the law by lawful means. When we look into the development of law, we can get to know that a large part of the improvement of law system is due to revising of the flaws of laws. Admittedly, obeying laws is of great importance to the stability of society. However, irrational obeying sometimes cause serious social problems, like the discrimination of black due to the laws such as forbidden of black children entering the school with only white students. Also we should see that pointing out the flaws are far more precious for it can promote the improvement of laws, which can hardly achieved by just obeying the laws.

However, disobeying and even resisting flawed laws can not be the correct solution to the problem. Revolution in the history which are most cause by resisting flawed laws are result in bloody conflict and devastation to people's confidence to the country and unfortunately hardly success. Nowadays, in a more liberal society, the time of solve problems with violate has past and what we face is a much more liberal and democratic society. Speaking out the flaws of laws and give suggestion for changing the irrational part is the favourable way for deal with the problems which can successful solve problems peacefully. Democracy, 1787, the first Constitution was born, instead of being fixed, 1791 ten amendments were added to the Constitution to ensure human rights. Until now, there has been twenty-seven amendments, much more words than the initial Constitution. Admittedly, when situation can not be changed by arbitrary government, we should take on our arms and defense our principle and right.

In sum, obeying laws is our duty but like every system cannot be perfect, in pursuit of making law more rational and just, it is also the very duty for us to indicate the law flaws in a legal way, which is of further profound meaning to us all.

I fundamentally agree with the author's assertion that making change to unjust laws is more important than merely obeying just laws. However, two specious claim(claims) are involved in the assertion. Firstly, it is an arbitrary division (改成it is arbitrary) that laws are separated into just and unjust. Secondly, disobeying and resisting may be not the accurate action to unjust laws, at least should not be put to the first position.
