题目:ISSUE 17 - "There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws."

As the speaker claims that every individual in a society has a responsibility to obey just laws and, even more importantly, should to disobey and resist unjust laws. In my opinion, I cannot agree this assertion totally; moreover, the final judge should depend on a case-by-case analysis and strike a balance between the so called just and unjust laws.
Frankly speaking, the very function of law is to bring stability and order to the group of people that the laws are enforced upon. For a legal system to work for a society the laws must be knowable, fair and implemented equally among the population.However, there exist some different views about the justice of the system of law.
At the first place, whether the law is just or unjust is different definition to various people. The fairness of any law depends on one's personal values, when the laws involves humans power and economical benifits, the law would not be sheer law, it changes into one' implement of interest. For instance, the law of U.S.-tax, many business human would hold the opinion that the law is unjust because it takes away many interest and benefits from business men, however, the country need the money from the revenue which pay by the firms and corporations to construct building and educational develop and other government movements, lack the economical support form business group, the prosperity and development of America won't be exist. And there has another example that the law about abortion in America, the controversial issue of abortion, individual with particular religious beliefs tends to view law allowing mother an abortion choice as unjust, on the other hand, the individual with other value system might view this law as a just law. In short, the definition of unjust or just law depends on different people who hold themselves value system.
Secondly, the fairness of a law also depends on one's personal interest, or stake, in the legal issue at hand. After all, in a democratic society the chief function of laws is to strike a balance among competing interest. Consider, for example, a law that regulates the toxic effluents a certain factory can emit into a nearby river. Such laws are designed to protect public health, but complying with the regulation might be costly for the company; the factory might be forced to lay off employees or shut down altogether, or increase the price of its products to compensate for the cost complacence.
Thirdly, the different areas in one country have different situations, and even between cities and suburbs also have various complex situations. For instance, in China, some areas live minority ethnic group whose local governments have special policies to govern the minority ethnic people, and the law in the mean time is different to them. May be in the eyes of majority, of course, the law is unfair; however, the most important thing in the whole society is stability and development. It is unadvisable and simple to divide and devise the law into two aspects of unjust and just. We should have a fundamental recognition that treat extensional situation use concrete law and attitude, only have the basic views that we can resolve the problem fair.
Otherwise, the assertion of individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws is not reasonable. If, every human in the society consider the law is not just to them, and they take the action of disobey the so-called unjust law, the function of law would not exist at all, all of the society would trap into the chaos and confusion because there lack strict system to execute the function of maintain the stability of society. What we can do in our society is to obey the forthcoming laws now, and when we confront the unsuitable law, we revise the flaws and shortcomings to make the system of law integrated.
In sum, the assert claims that society has two kinds of law--just and unjust. Thus we should disobey and resist the unjust law. Yet, it is not suitable only divide the system of law into two aspects, and, disobey and resist the unjust law is not the best solve means when we really face the issue. In the final analysis, we should strike a balance between the just and unjust laws and we should obey laws because we are the citizens in the society, after all, sometimes law is blind but not simple. |
