180. "Many problems of modern society cannot be solved by laws and the legal system because moral behavior cannot be legislated."

As intelligent beings whose behaviors are formed by, depend on and regulated by the surrounding community, human beings are largely defined as “social man” and can hardly be isolated from society. The legal system, which is the fundamental mechanism for regulating human’s behavior, however, can not solve all of the problems existing in contemporary age for a series of reasons.

To begin with, laws, although seemingly just and fair, have nevertheless be the ultimate representative of the wills of the ruling party and can not be regarded only as effective ways to solve social problems. Admittedly, with their basic principles of maintaining the stability and facilitate the development of a society, laws and regulations do have great positive effects on the aspects of prohibiting crimes, protecting the human rights, setting up decent social orders and so forth. However, due to the nature of laws, they inevitably have flaws whenever the interest of the government is concerned. In a lot of countries in the worlds nowadays, news industry is not fully independent and have to operate under the guidance of the government. Therefore, they lose, to a great extend, their function as supervising and reporting force in the society. Such inability of laws are part of the reasons why they can not solve all of the problems.

Secondly, legal system is not and should never be the only way to provide guidance for people’s behavior. Long existed moral standards shall always be an equal, if not more, important means for regulation. Moralities, which have been existed in a certain society for thousands of years, never fail to represent the commonly accepted standards for good and evil. Different from the outlined law provisions, moral standards are deeply rooted in everyone’s mind and can act spontaneously to restrain people from conducting misdemeanors. Chances are that some of the deed that is allowed by the law but still have detrimental effect on the society, can only be prevented by moralities. Where marital problems can be one example, the divorce rate of all most all modern societies has soared in the past century, while some of the marriages are really nothing but mistakes, some case of divorce was merely a result of irresponsibility and immoral affairs in which case greatest damage has been done to the children. Certainly we can not prohibit divorce completely, so the responsibility of maintaining the harmony of the family and therefore the stability of the society can only be shouldered by moralities.

Last but not least, even when crimes are concerned, laws are not the only solution, let alone the most effective one. Some of the criminals are motivated not by ferocious ill-will, but by other causes and where left with no choice. For instance, some juvenile criminals were largely the result of social pressure or coercions of evil bangs, there are also a great many thieves and prostitutes are nothing but illiterate and impoverished individuals. While law can somehow punish the law-breakers, it can hardly solve the very origin of these problems. Insightful decisions and correspond efforts should be made before the problem can be deracinated.

In summary, laws and legal systems are certainly not panacea for all the social problems, while moral standard being one of the omitted elements, there are still other factors to be taken into consideration when the ultimate interest of all the people living in modern society is concerned.

Well Done!

总的来说,写得不错的,挺流畅的。但例子举得不太好,还有你一直强调除了法律以外还有其他因素,那么你没有很明确的列出。我觉得这篇能上4分。

题目是:

第一个例子的确是不怎么样,当时有点乱,只想到法律的缺陷,为政府服务等等。
第二个例子 我觉得没什么问题啊。正是说明有很多问题不能被法律解决,比如离婚率等(本来想写早恋,堕胎什么的,呵呵,但估计写不出来,就选了这个比较容易的例子)不能用法律禁止,但可以由道德约束。符合题目的要求啊。

与西红柿蛋JJ探讨。(我也很喜欢吃,而且最近看了一份报道,说西红柿炒蛋营养价值极高!!)

Chances are that some of the deed that is allowed by the law but still have detrimental effect on the society, can only be prevented by moralities. 我个人认为你说得有点牵强。接着你举的例子是divorce,我私下认为老美不会那么看问题的,有时他们在离婚诉讼是涉及的property distribution难道可用morality解决吗?Certainly we can not prohibit divorce completely, so the responsibility of maintaining the harmony of the family and therefore the stability of the society can only be shouldered by moralities.是吗?能行吗?你说得有点绝对。我觉得你不如还是举abortion 好一点。

仔细看一下是发现语言太绝对化了。可能老美在这个问题上的观念也不一样,不过我的意思是认为离婚对社会稳定,子女教育都有很不利的影响,但又不能用法律明令禁止,以此证明法律不能解决所有问题。
abortion当然好了,不过那个问题更复杂,我在平时习作的时候都不敢提,估计上了场更加…,还是找比较通俗一点的好。怕怕的说。呵呵。
