180. Many problems ofmodern society cannot be solved by laws and the legal system because moralbehavior cannot be legislated.

It seemsthat there are always so many problems in modern society waiting to be solved.Can they be solved by legislating the moral behavior? This assertion assumesthat modern social problems mostly come from moral issues; however, in fact, itis not the truth. When discussing how to solve modern social problems, what isneed is to research how they were born first then the ways to solve them. In addition,moral behavior still plays a significant part among them.

First, inthe respect of the origins of modern social problems, moral is not the only orthe main factor all the time – even in some old school thinking, it was. Anymodern social problem relates to various of factors, which are influenced byeach other at the same time, such as education problem, gender inequality, andhealth care delivery. Just discussing the education problem, since it is the resultof several different factors including funding, teacher quality, standardtesting, racial imbalances and curriculum in relation to the labor force needand global competition; how can it be solved by legislating the moral behavior?Of course, government makes some laws and instructions to make sure thatchildren get elementary education, but it has less busyness about moral butmore about the development.

Second, inthe respect of the influence from morals to laws and the legal system, there are two levels. Onone hand, laws and the legal system base on the foundation of morals and valuesof the majority in one society, so some moral behavior can be legislated bylaws and legal system, at least. For instance, stolen and murdering is objectto the moral standard of majority and hand they are quite a type of crime. Andlaws prescribe that parents should raise their children while “ngo”s have therights to free of taxes. In this level, laws and legal system can protect the mainvalues and keep one society in balance and some kind of health by laws andlegal system based on moral standard.

On the other hand, quit a lot of personalbehavior is difficult to define by laws and legal system, even they having thetags of “moral” or “immoral”; otherwise, there is no “free will” or “humanrights”. If a husband betrays his wife while she still in love with him – insome people’s eyes, of course it is immoral; - however, the husband does nottransgress the law. If government legislated the loyalty of love, then it meansthat one will never have other chance to choose again even the former choice isnot suitable. Dose it work? Never. Meanwhile, different people hold thedifferent views of what is right and what is wrong in details, while themembers of the same society have the similar values and moral standard.

In general speaking, the ways tosolve modernsocial problems not only depend on legislating the moral behavior but alsodepend on balancing various of social factors. Personal issue and public dutyhaving something to do with the social issues can be encouraged or not, but cannot be legislated.

In general speaking, the ways to solve modern social problems not only depend on legislating the moral behavior but also depend on balancing various of social factors. Personal issue and public duty having something to do with the social issues can be encouraged or not, but cannot be legislated.
