TOPIC: ISSUE 17 - "There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws."
WORDS: 577 TIME: 0:43:40 DATE: 2006-2-22
I fundamentally agree to the speaker that, the individual in a society has a responsibility to obey just laws and to disobey and resist unjust laws. However, the principle which we use to judge the unjust laws and the way we resist or disobey the laws are very important, and needs considered maturely before we take any action.
The laws serve a variety of functions. Laws against the crime, limit the power of government or people in high positions, protect the children in poor families get the loan for their educations, and help to solve conflicts smoothly in a peaceful way. The purpose of the laws is to establish a peaceful, orderly, relatively stable society. Laws are the rulers which ask all the citizens to obey them, and we need the existence of laws to preserve such a good environment to live in. In order to attain the goal, laws are enforced by the courts. If some one breaks a law, he or she will be punished. The punishment has nothing to do with the personal willing, for it has been judged by the principle of laws. So the law-breakers will be forced to pay a fine, or pay for a damage, or go to prison, no matter whether they would like to.
The standards which we use to judge a law just or unjust have not exact identify. It is possible that some items of the laws disturb part benefits of some individual. However, we can not resist laws because they are unjust in our personal view. For example, the transport laws in China order that all the auto drivers should drive their cars on the right side of the roads which have two sides. If some one think this regulation is bothering, because they like to drive on the left side, and they just do what they like to do on the streets ignoring the transport laws, accidents must happen every day, cars are destroyed, people on the street will be hurt or even lost their lives, and the drivers who disobey the laws will be punished for their behaviors. So most of the time, we have to endure some little expense to abide the laws, but we get the regulations to help everything move on peacefully and safely.
On the other side, if the laws actually be established to be unjust for some reasons, and they really make some people suffer great losing. People have the right to speak out publicly and to seek to change the law by lawful ways. The way to show our resistant are very important, we have to solve these unjust affairs in peaceful and lawful ways, too. The power of laws is so great, they have the right to put punishment on anyone who disobeys them, and they have the right to use the army force. So for individuals, the cost of the resistant is huge if they are not by the lawful ways. These individuals might be judged by the court like criminal, and they may lose more benefits or even their lives without any changes in the unjust laws.
In sum, the existence of law is necessary to all the people, and before any changes are established by the court or law-makers, every one has to obey these laws. Even we find the laws are actually unjust, we have the right to public our views and try to change the laws in lawful and peaceful avenues. |
