There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws.

Does every individual in a society have a responsibility to obey just laws and, more importantly, to disobey and resist unjust laws, as the author asserts? In my point of view, I fundamentally agree with the author's simple classification of the types of laws, however, in any society it is almost impossible to differentiate the laws so clearly. Just like Tomas Jefferson had said, "No society can make a perpetual constitution, or even a perpetual law."
Admittedly, the laws play a significant role in any society, the great ancient Greek philosopher Aristotle had said that "Law is order, and good law is good order." Thus, with the laws set up by the government, the whole society might be more orderly; it is good to the development both in economy and other social fields. However, even if in modern society, sometimes whether a certain law is just or unjust is still hard to discriminate, maybe some behaviors which are illegal in one country while in another country they are legal. Even in different state there also have these similar situation, in this circumstance, it is difficult to say that whether a law is just or not, people in different places might have different opinions on the same issue.
Generally speaking, I support the author's claim that every individual has a responsibility to obey just laws. Any country or state needs a good and orderly social environment, although different people might consider that a certain law is unjust to them, we must have an objective judgment from jurisprudence while not from personal aspect. The society would loss its stability if all the people could disobey the laws willfully.
To the opposite, if the law is really unjust for most of people, then, any one in that society should take the responsibility to disobey and resist unjust laws. Take the American politics on the blacks in 19th for example, at that time, the blacks had no right on vote and even had no fundamental rights just like the outsiders. In this circumstance, all the people should stand up to resist these unjust laws. Another example is the requirement of eight hours work in a daytime, this behavior should be supported and should be persisted until getting to the end. Thus, people have rights to question even disobey these discriminate rules.
To sum up, I think that most of the laws built up by the government are just and all the people should obey them, but in some cases, the laws are indeed unjust to most of the people in that society, then, it is best to disobey and resist the unjust laws to reach for the just laws and equal treatments. |
