Issue17 just and unjust laws
“There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws.”
Today, there is always a controversy that some people believe that everyone in a society has an obligation to obey just laws but could disobey and resist unjust laws, others argue that whatever the law is just or unjust, people have the responsibility to obey all of them. In my point of view, I support the latter attitudes toward laws, although someone may claim that lots of laws are unfair to a part of people.
To begin with, it is entirely correct for everyone to obey the just laws. As we know, to obey the laws will allow the society to run regularly and safely, though sometimes people will be restricted by laws. These seemly restrictions will eventually bring about benefits and conveniences to the populace. For instance, everyone should have the experience about the traffic laws. When people drive to the cross road, there are always existing traffic lights. Then the cars should stop to wait when encountering the red light. It seems to hinder our trip, but considering without the traffic lights, maybe more often the traffic jams will happen there and even the traffic accidents. So we can conclude (see that) the laws on the traffic lights will actually bring us convenience.
However, someone will argue that the just laws are certain to obey but what about the unjust laws. My response (reply) is that people also need to conform to the unjust laws. The most important reason is that different people have different opinion about different laws, some may think it just and the other may argue it as unjust ones. Therefore it can not determine which laws are just or not just according to the personal opinions. If everyone has its own criteria about the justice of laws and merely obey these just laws, the society will be extremely instable. Here is an example happening in China. The well-known Three Gorges project is taken in Hubei province in China. For the project, many people who live there generation by generation will be forced to leave the three gorges area. These people think the laws forcing them to leave their hometown very unfair, but most people believe that this Three Gorges project will actually bring about large benefits to all of the Chinese. If these native people in three gorges area resist the laws and government intensely just according to their own standards about laws, they will bring large disaster the society.
Furthermore, if a large part people of the country feel some laws actually unjust, they should wait to amend these laws, meanwhile people should still conform to the laws before the amendment of these unjust laws. For the laws in any country, when the laws were firstly made, they might be just to the people and society, but with the pace of the society's development, it turned to be unjust. So it needs the legislators to amend those laws. And in the any democratic country, the unjust laws will be modified or replaced eventually.
To sum up, no matter whether the laws are just or unjust, people are obligated to obey them in order to keep the society regular, stable and convenient. People should not conclude the justice of laws just according to their own opinions and interests, and decide whether to obey these laws. If some laws are certain out of time, people should amend or replace those laws through the legislations. |
