     I partly agree with the speaker that laws and legal system are ineffective in solving certain social problems which are due to the lack of consensus on moral standards. But it’s too absolute of the speaker’s assertion that moral behavior cannot be legislated, because law is deemed to enforce basic moral requirement.

    Law and morality are closely related rather than two independent systems. Morality is originated from social consensus. From a historical perspective, law came after morality as a force to make the consensual morality inviolable rules. Thus, morality is embedded in law system; In other words, law is the legislation of basic moral behavior. In modern society, moral laws are changed into legal norm and positive legal standards are changed into legal guidelines. Taking Chinese Civil law as an example, the legislated principle of honesty , fairness and respect the aged and care for the young all came from moral obligation. Meanwhile, the negative moral obligations are made into legally forbidden behavior, such as not to cheat, perjure , bribe and take bribe. So generally speaking, one can discriminate illicit behavior based on moral common sense.

    Honesty and fairness are highly consensual standard thus can be legislated. However the issue which concerns different opinions can’t be enforced by law, for everyone has freedom of faith. Discrimination is a big setback in society. It would result in estrangement and hatred. Although human beings have achieved a lot in mitigating sex discrimination and racialism, discrimination still exists in every social aspect such as misconception of people with AIDS, few job opportunities for the low-educated, and is not likely to be eliminated.

     Although basic moral behavior can be legislated, a good society needs far more than that. Love and empathy is what makes the society warm and livable. Love is such a subtle and noble affection of human being described in countless art forms and literature. In spite of that, no law text can be found about love. Whereas the unspeakable love is the foundation of a society to some extent. In recent decades, aged people has become social vulnerable group . Legal system can guarantee them the basic living but can not provide a happy one. A social investigation shows that most aged people feel lonely and frustrated from time to time. The bad mood even causes physical
and metal disorder which is called “Empty nest syndrome for the elderly” . As the whole world has gradually stepped into an aged society, bad mental condition of the aged has become a serious social problem which calls for love and empathy from every social member.
    To sum up, morality, if it’s highly consensual in society, can be legislated. But as far as it’s concerned with different opinions or something as complex as love, legislation is impossible.
