Law, the creation of country, is a systematic order to resolve conflicts among people, defend the innocent by punishing the violator, and maintain the control by keeping warning people to obey it. The idea of law is based on people's consensus on just behaviors and unjust behaviors. Neverthelss, unlike law with visible soical record,the idea of justics is much more intensely personal matter and may vary in accordance with certain conditions. History reminds us that he unjust laws in history has controled over the country and people, from Qing Dynasty to present China, from east to west. But should people succumb both the just and unjust laws ? Of course not, as what the argument claim, every individual has the responsiblity to obey the just laws and courage to disobey the unjust laws.
Just laws are based upon individual's inalienable right of life, liberty and pursuit of happiness. Therefore one person's gains should not be at the expense of another person's lose. If one pursues his rights to happiness while impeding others to obtain their happiness, this act would led to the conviction and imprisonment of the offender. Take robbery for example, in order to gain happiness, violators would rob others private possessions. If law does not punish the robber, law does not act justly to compensate for the owener's loss.
Laws, if were carried out justly, would treat each one equal, irrespective of power, family background or special interests.
Ideal as it sounds, laws, however, can not always be the super objective arbiter. If the founding principles are unjust, then how can all the people be entitled the same right. Unjust law is not law at all, as St Augustine claims. If that is not law, then we as the human, with unalineable right, should have the courage to unbreak the unjust laws. Women in history teach us a great lesson in disobeying unjust laws. Ever after the Enlightenment, the idea of automony has engrained in people's minds. Women who had been treated unjustly for a long time, began to take actions to liberate themselves and break the unjust laws. In 1848, hundreds of women gathered in the Sceneca Falls to declare their response to unjust laws on women, which marks the beginning of feminist movement. In the old days, women were not allow to attend schools as man do, women didn't have the right to divorce, and women even didn't have the right to go to work. These unfair and unjust laws put women in a very inferior places which contradict the idea of equality and human rights. Under such cirsumtances, women has the responsibility to disobey and unjust and demonstrate for their rights. |
