It is possible to pass laws that control or place limits on people's behavior, but legislation cannot reform human nature. Laws cannot change what is in people's hearts and minds.

I strongly agree with the speaker in the assertion that laws could be legislated to control or place restriction on people's mind. However, whether the legistation can reform human nature, so as to change people's belief or thought should depends on whether the law is just.
First and foremost, laws regulate human behaviours in its legislation forms. According to the definition of laws:" Law, body of official rules and regulations, generally found in constitutions, legislation, judicial opinions, and the like, that is used to govern a society and to control the behavior of its members. " Any field of society, even the society itself, should institute its own legislations in that they could serve as the basic criterion to help to maintain a peaceful, orderly, relatively stable society. For instance, courts contribute to social stability by resolving disputes in a civilized fashion. Property and contract laws facilitate business activities and private planning. Laws limiting the powers of government help to provide some degree of freedom that would not otherwise be possible. Law has also been used as a mechanism for social change: at various times laws have been passed to inhibit social discrimination and to improve the quality of individual life in matters of health, education, and welfare.
It is true that law exerts its function through the coersive and compulsory methods. Nevertheless, whether laws could change the human nature could be analysis in their characte, that is to say, whether the law is just or unjust.
Admittedly, laws have always under a process of being changed and imroved according to different times. However, in our history, there are periods when knowledge and thoughts are insufficient which cause the law under the shackle of religion or tradition. For example, in the avenue of searching for the scientific truth, Giordano Bruno was executed by the Roman Catholic Church for the crime of heresy. And Civil War, a movement to break the unfair law, eventually emancipate the black slaves from depriving their individual freedom and disenfranchising their suffrage. Unjust laws cannot, wil never, reform people’s heart and mind towards truth, justness and freedom.
Whereas, in modern world with highly civilized society and progessive development, most of our laws are institute to protect justness and the general will of the citizens. Sometimes a statute would give the culprit a brainwash to avoid them going astray again. Given that an adolesent whose parents got a hard disease and lack of money to get medical treatment s, then one day, the child slipped into a shopping mall with a gun and stole the money. Immediately, the alarm rang and the child was arrested. Then law enforcement agency sends him to the reformatory to get an education, and his parents may be helpped by the social welfare institution. Such an example is easily fetched in our society. In the final result, the child is educated to change his thought of resorting to criminality when fronted with difficulties.
To sum up, it is the law that place the limits on human’s behaviours. What should be more important is that the government, especially the legislation instritution, should respect the general will of the majority, but not take the laws as the tool of totalitarian which will inevitablly impede the development of society and, contrarily, increase the disobedience. |
