Issue 174 "Laws should not be rigid or fixed. Instead, they should be flexible enough to take account of various circumstances, times, and places."

A system of laws should be judged as a just one can only illustrate the system is apt for its society, however, we could never say the system should be last permanently without any change during the long journey of human beings. I strongly agree with the speaker that any law, no matter how rational it seems nowadays, will and must be changed to some extent in the future.

To begin with, the conclusion above is based on the undeniable fact or truth: nothing in the universe, or at least we--human beings could not tell, can survive forever due to our limited life--we human beings must not be able to live as long as the universe. Thus we may accept truths today, but we have not the ability to conform its unchallenged and permanent true property, letting alone how authentic it may be nowadays, since simply we do not have the ability to identify its truth during our human beings measured life comparing to the universe. Therefore, since we can never tell any law's rigid consistence is apt for any society later, the only chance left for us is to find whether the flexibility in laws should be acceptable. Luckily, the history has explained the importance of changeable laws sufficiently. Let us turn to the crucial laws which existed in ancient China. The extremely brutal laws claimed cutting arms as a punishment of theft and stolen crime, which is unimaginably anti-human and irrational to our current society. Were the laws never changed or fixed, the civilization, not to mention democracy, would never have the chance to be addressed in the table of history. From the profound lessons learned from our ancestors and past laws, the extent to which culprits should be punished constrained by the laws should be determined by taking the extent of harmful effect resulting from the crime, humanity, various circumstances and other factors into consideration, which render the law system must be flexible enough.

Moreover, the changeable and rational system of laws is an insurance of public security, and even the very survival of the government by which the laws are conducted. Consider, for instance, the laws protecting the rights of women of minority. Centuries ago, women and minority are groups that lack of attention and protection from the society, leading to many infringements of these groups, not only in physical bodies but also in psychic mentalities. This gender or racial discrimination directly led to many crimes such as robbing in the streets, violation, and civil disobediences
resulting from the poverty of the groups, which was indeed caused by few attention paid by the government and the public on the groups' education, industry, and culture. Due to equality between the female and the male, the majority and the minority, the government had to change its laws in order to ensure these peoples' rights in education, paid wages and protect the minority culture, and at the same time to decrease the incidence of streets crime and to maintain the peace of the public.


Some people may argue that many laws have been consistent for centuries and there is still no sign in fixing it. Admittedly, this is true in some extent, especially in a society where its authority has lasted for a noted long period. Take many laws in North Korea as an example. Nevertheless, just as discussed above, since none can guarantee the permanent survival of the government in North Korea, then no one can make sure these laws may exist without any change forever. Besides, the poor economic threatening the normal living standard of most North Korea people is now shaking the system of its laws, which at least could be told from its few interaction with other governments.

In sum, any law should be existed as changeable and flexible. Only by insisting the changeability of the rational laws can a society survive long, either from the perspective of the lessons learned from the history or the fact that none can ensure rigid laws' position in the future.
