Laws are an important and essential meansto maintain society order, protect human rights and individual property.Undoubtedly, as the cornerstone of society, it is everyone’s responsibility to abide by just laws, and in face of unjust laws, radical, extreme disobedience and resistance will only lead to chaotic situation, therefore, in order to makeunjust laws fair and complete, we should resort to peaceful approach.
Laws are the core foundation to society, and thanks to law that our world works steadily. Society is a machine, and law is the gear. The principal function of law is to main society order, protect human rights and individuals. Any laws that satisfy these goals are just laws; it is everyone's obligation to obey just laws, which not only it is everyone’responsibility but law can truly protect us from injury and financial loss. Forexample, anyone who kills a person or steals money will be put into prison. Lawcan also dispute controversy in business. Take Anti Trust Law for instance, it willseverely punish monopolistic companies to promote a fair-play environment. Acouple of years ago, Europe Union dictated it is illegal to bind Windowsoperating system with Internet Explorer, for consumers have free choice toinstall any internet surfing tool. Since then, the profit of Firefox and other companies has been rising and today we are glad to see there is a very fierce competitionin web browser and consumers have more and better choices.
According to the criteria above, unjustlaws hinders social progress and against social values. But since the first lawof the Code of Hammurabi legislated in Egypt thousands of years ago, no law has been and will never be perfect and absolutely just, because they are legislatedby sentimental human beings. Defects of laws typically are represented by unfairness, and this unfairness has a distinct feature of relativity. Laws onlymaintain some people’s interests while impairs others’ interests. For example,a new manufacturing factory will be built in a town with high dense population, and it will cause serious pollution to local residents but will yield highprofits. The local government dictates the factory construction is legitimateby considering huge tax revenues and incentives to employment. However, forlocal residents it would be obviously unjust since their health will beendangered. Further, laws represent ruling class will, and a vivid example ispropaganda control. Some countries (especially in Asia) exert control overmedia that media should only extol choirs of their governments. This wouldcertainly protect ruling class yet free speech is severely jeopardized.
On the other hand, radical, extreme disobedience and resistance of unjust laws is unwise and infeasible. Theseactions will not lead to a win-win situation but a chaotic situation, further, social order is broken; thus everyone’s interest cannot get guaranteed, and ultimatelythe whole society is paralyzed, and by no mean it does good to anyone.
However, in face of unjust laws, it is feasibleto perform necessary and peaceful actions. This would not disturb social order norimpair other people’s interests, and more importantly, arouse government’s concernto revise unjust laws. For example, after Civil War black people had been stillin a very inferior status and were discriminated in many aspects of life. In1955, Rosa Parks refused to give up her seat to a white man and local authoritydictated she broke the law of racial segregation arrested her. Martin LutherKing waged a large-scale, non-violence campaign to defend black people's humanrights and eliminate racial segregation. This movement lasted for over a year, and finally the Whitehouse realized the urgency and then legislated Civil RightAct. If there were no such resistance, central government would not act, atleast so quickly. In short, disobedience and resistance of unjust laws can onlybe limited to a rational scope.
Fortunately, mankind has realized laws havedefects, and have setup special agencies to modify laws. In the United States,Congress is an agency to legislate new laws, and more importantly, modifyunjust laws that are either unfair or cannot reflect today’s social values. Today, individuals and organizations can propose ideas to improve laws. Anotherexample is that in past days personal information leakage did not break law norwould cause heavy loss, but as we have entered an electronic and computer era, privacy has been unprecedentedly critical for every person that today manycountries have legislated laws to protect personal privacy. Therefore, withhuman development, laws are becoming more fair and complete.
Laws, as the core of society and aprinciple means to maintain social order, protect human rights, require everyone to observe. In face of unjust laws, it is unwise and infeasible to take extreme, insane actions to disobey and resist laws, but instead we can resort to peaceful measures to arouse government’s concern in order to modifyunjust laws.
