思路:
第一段:摆观点,the speaker's assertion, while appealing in some aspects, is fundamentally a specious statement. 第一句话忽视了to judge a law's fairness depends on one's position.第二句忽视了disobedience和resistance的负面社会效果。
第二段:法律很难判断是不是just的,因为它平衡的是社会不同classes,nationalities和regions的interests,beliefs和customs。站在不同的position上对法律的看法就会不同,比如说中国开设特区,特区乐了,别的地方人觉得不公平,但是这种law还是有strategic meaning。
第三段:对法律的disobedience和resistance可能会带来严重的社会问题,破坏社会秩序,影响人民生活,比如说Chinese birth control policy, giving births to children without limits could lead to the collapse of our society。
第四段:说有其他正常的途径可以去调整法律,在中国,有人民代表大会制度,people can put forward suggestions to their representives who can advance bills in National People's Congress. In this way, even if those so-called unjust laws indeed exist, we can adjust them peacefully.
第五段:conclusion,actually,there is no absolute just or absolute unjust law,the criteria towards a law depends on people's various position. Moreover, the disobedience and resistance toward law can bring about some serious effect,所以,the topic不正确。
I find the speaker's assertion, while appealing in some aspects, is fundamentally a specious statement. Firstly, it is unjust itself to judge a law by ourselves, cause judging a law's fairness depends on one's position, different vocations, ages and education degrees can lead to different judgments. Secondly, the disobediences and resistances that are encouraged by the speaker could be very dangerous. These reckless actions might jeopardize our society directly. Consequently, I totally disagree with the speaker's statement.
It is hard to judge a law, because most of us individuals cannot take comprehensive view of general social situation. The purpose of legislation is to balance the various interests, beliefs and customs that belong to disparate classes, nationalities and regions. For instance, the issue of the establishments of special economic districts where locate in Chinese east coast was controversial at once. Chinese government's extremely liberal economic policy brought the fast prosperity around east but also brought the discontentment around west. However, admitting the fact that the law is unjust to western people temporarily, it is remains a prospective strategy in long term, because the prosperity of the east will support the development of the west finally. Hence, if I were the speaker, I would not judge a law's fairness.
The speaker's second claim encourages us to obey just laws and resist unjust laws. As far as I see it, the behaviors of disobedience and resistance toward laws could bring a series social problem. These actions might damage the social orders and affect the peaceful lives of our people, and furthermore, they might even develop into gory violence incidents. To illustrate my view, I would adduce Chinese birth control policy as an example. Some people argue that giving birth to child is human right; nevertheless, considering the tremendous number of Chinese population, giving births to children without limit could lead to the collapse of our society. Therefore, it is short-sight policy to disobey or resist unjust laws base on our subjective understanding.
In my view, if our laws have flaws, there are many ways to adjust them. In China, where practices National People's Congress (NPC) System, people can put forward suggestions to their representives who are a member of NPC. Then, the representives can advance bills in NPC and advise the congress to adjust the laws. What is more, NPC actually is the Chinese legislative body, and therefore, this connection between legislation and reflection can be very direct and effective. In this way, even if those so-called unjust laws indeed exist, we can adjust them properly. We should realize that, facing these problems, individual's obedience and resistance are weak and it is a rational legislative system can really solve the problems.
To sum up, actually, we should be aware of that there is no absolute just or absolute unjust law at all, and the personal criteria towards a law depend on people's various positions. Moreover, the disobedience and resistance towards laws can bring about some serious effect in our society. Obviously, we could rely on our legislative system to perfect our laws. Knowing this, I totally disagree with the speaker's statement. |
