I concede with the statement that each individual has the responsibility to obey just laws, but in terms of whether laws can be classified into two types, the just and the unjust, and the assertion that individuals should disobey and resist unjust laws, I have reservations about this point of view due to several reasons.
Admittedly, it is difficult for legislators to take every situation into account, hence laws which are injustice is unavoidable. Moreover, there is a long process since the acts are introduced and they are widely applicated in practical life by the public. During this process, new problems may arise, which obviously cannot be foreseen by the legislators. Euthanasia, for example, is a controversial issue over which people debate for years, the fact that killing people is forbidden by laws and the reception in ethics and morals that euthanasia can extenuate patients’ affliction is always a collision. But when acts on killing people were introduced, euthanasia did not even arise. Therefore, if legislators knew there will be a conflict between morality and laws over this issue, they may consider it twice whether killing people should be judged as illegitimate.
Furthermore, People's judgment on whether a specific law is just or not depends on their values and outlooks. As a result, there is no absolute criterion to justify which laws are just while others are unjust, since the criterion of justice and injustice is identical for each person. For example, when legislators in southern states of the U.S. carried out the apartheid acts in the nineteenth century, they were panegyrized by white people who have the conception bred in the bone that the black are lazy, imbecile and violent; while for the Africans they undoubtedly mean unequal treatment and discrimination, because due to these acts they lose the equal rights to employment, education, expression of political opinion and so on. For this reason, the relative justness of a law is closely in correlation with the social roles each individual plays, and interests the mainstream occupies in the law.
In the second place, the original intention of a law's legislation is to maintain an 'order' which every individual obeys so that the society can function stably. If anyone only chooses the laws they appreciate to obey and disobey or even resist laws which are viewed as 'unjust' in their criterion, turmoil will inevitably erupt. For instance, people in favor of possessing guns will be encouraged to buy firearms; those who are in opposition to forbidding drug merchandising will sell drugs overtly in public places; and an even more serious situation, criminals think that constraint, a deprivation of their personal freedom, is apparently unjust for themselves and consequently they may choose to break jail to protest. If the entire above are brought into reality, indubitably aims of disobeying and resisting unjust laws are completed, however, stability of society no more exists, then where does the function of laws lie?
Therefore, resistance and disobey is not only an extreme and irrational behavior, but also inutility for social development, and thus should not be the resort to convey the dissatisfaction with unjust laws. The consummation of legislation, just like child’s growing up, needs guidance and remediation in a proper way. As far as I am concerned, the correct attitude toward the flaws of established laws is to make suggestions to the legislators through proper way. Only in this way could social regulations be perfected and meanwhile we maintain our legitimate rights and interests.
