Pro Bono Requirement
The State of New York has established a new 50-hour pro bono service requirement for applicants for admission to the New York bar. In New York, bar applicants must first take the bar exam and then apply for admission to the bar. All applicants who will be admitted to the New York bar on or after January 1, 2015 must complete at least 50-hours of qualifying pro bono service before filing an application for admission. Results for the July bar exam are normally released in November, with the earliest date to swear in and become formally admitted the following January. For example, students who sit for the July 2014 bar exam will be admitted after January 1, 2015 and be held to the new pro bono service requirement.
Applicants may begin their pro bono work at any time after they commence their legal education in the United States; that is, LL.M. applicants may complete the requirement during or after their LL.M. course of study. The requirement may be completed before or after taking the bar exam, but must be completed before an applicant submits an application for bar admission, which takes place after having passed the bar exam. The 50 hours of pro bono work may be performed anywhere that is convenient for the applicant, including, in another state (for example, in California) or foreign country. If the pro bono work is performed, in whole or part, outside the United States, applicants will be required to explain in detail the nature and circumstance of their work as part of their application for admission.
In general, qualifying pro bono work includes work performed in the service of low-income or disadvantaged individuals who cannot afford counsel and whose unmet legal needs prevent their access to justice; work involving the use of legal skills for a tax-exempt organization; or work involving the use of legal skills for the court system or federal, state or local government agencies or legislative bodies. Work tasks must be law-related and supervised by a licensed attorney. The work also must involve the use of legal skills or law-related activities that are appropriate for lawyers-in-training not yet admitted to practice. Paperwork is required to be submitted on which the supervising licensed attorney confirms the applicant's completion of 50 hours of pro bono service.
