TOPIC: ISSUE17 - "There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws."
WORDS: 571 TIME: 0:45:00 DATE: 2007-6-22
Is it that disobeying and resisting unjust laws is more importantly for every individual in a society then should the responsibility to obey just laws? I fundamentally agree with the author on the basis that it is every citizen's responsibility to obey laws. I hold the conviction that, more importantly, no matter what the laws are just or not, the activities disobeying and resisting laws have formidable influence to the society and individuals themselves.
First and foremost, it has great contribution to the development of society, if people could eager to challenge with the unjust laws. Laws are the tools used by the authorities to administrate the whole nation and keep everything in control. With the limitation of purpose of legislating and the cognition to the matter, the laws cannot suitable for every person and all kinds of situation. So that the unjust laws are inevitable exist. To make the system of laws more justice, there must be someone stand out to fight with the unjust laws. But the way is not disobey or resisting, but using rational method to call for the masses' support. A good example in this point is Martin Luther King, who was the top leader of Civil Rights Movement. Martin Luther King used his elocution, such as the most famous speech "I have a dream”, to arouse people's concern for the balance of civil rights, especially for the Africa Americans. More and more people took part in the campaign and finally the lawmakers had to amend laws to give Africa Americans just treatment. And such examples are adequate in the history for people to learn, for instance, Gandhi, "the father of India", claimed using an ashisma movement to struggle for, and finally achieved, the independent of India from the unjust domination of England. Using rational ways to challenge with unjust laws is a advisable and effective way to compel the development of society.
Next, if as the speaker asserted that people disobey and resist so-called unjust laws will make great negative harm for the society. On one hand, most of time, some of the people would use "unjust laws" as excuse for their illegal acts. Indeed, it is just opposite to their own avail or pleasure, but not so-called "unjust". Taking juvenile delinquent for example, some of the young people recognize that the laws combine them to much, and infringe their rights to look for freedom. So their actions touches on betrayal, most of them feel highly honored by disobeying or resisting laws they definite as unjust limitation to their freedom. This phenomenon is not any one want to see, and have no positive effect to the society. On the other hand, even the activities which are for the positive purpose to disobey or resist unjust laws, always have negative harm for the society too. Abraham Lincoln who fighted against slavery, partially caused the American Civil War. It is true that this war overturned the unjust laws or treatments toward slavers, it also broke the peace as other wars did of the civilian. Thus, at hardly most of the time, disobey and resisting laws is not a feasible choice to struggle for equal rights.
In sum, the law, like most things, cannot be perfect, but once legislated, and should be closely obeyed. To make the law as just as possible, we need to use rational way to compel the development of legal system.
