TOPIC: ISSUE17 - "There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws."

According to the speaker, each citizen has a duty to not only obey the just laws but also disobey the unjust ones. I cannot agree with the speaker for the reasons following.
The fairness of a law usually determined by individual interests. Citizens of a sciety have different background, and the judgement of one person is subjective. For example, the contravicial issue about abortion. Some people think it is the freedom of each mother, but some religion groups think it is unacceptable. Another accurate instance is that to reduce the traffic jam of downtown, many cities charge a fee of these cars which come to some certain dictricts. Some people would think that go to somewhere is the right of a citizen, the fee is unreasonable. On the contrary, because of the government spending most of these fees on the public traffic, and the traffic jam is dramatically reduced. This policy would be welcomed by many people. If everybody of a society disobey the laws which they think unjust, chaos would be the end.
To disobey unjust laws always could not attain the purpose, even worse. For example, some people claim that the tax of incoming is too high, so they use various methods to avoid to pay the tax. The results of these actions must be that the government would higher the fax of incoming to ensure the budgets, and take some strict regulation to prevent and punish the action of tax avoiding. At last, people have to pay more tax. So, to disobey even resist laws in the name of unjust is unwise.
The inherent fouction of our laws is to balance competing interests. There are numerous interests in the society, most of them are compete to any others. It is necessary that a law to balance these interests, and mantain the stability of whole society. A suitable example is that the regulation of restricting the pollution. Such a ban would charge the factories which cause the pollution a lot. So, the interests of factories are violeted, but more citizens' interests are protected. On the contrary, the policy of building more factories could polute the air, and the interests of citizens are violeted. But more factories means more tax which would be used to improve the live-level of citizens. In short, the main purose of law is balance overall interests of the sciety, so we must obey the laws.
In sum, it is citizens' right to judge if a certain law is just or not. However, whatever the case is, it is the responsibility of everybody to obey the laws. |
