The speaker alleges that laws are dividedinto two types, just and unjust, and every social member has a duty to not onlyobey the just laws but also disobey unjust ones. In my opinion, I concede thata major part of statement is undeniably convincing, while to disobey evenresist unjust laws is somehow unreliable.
Admittedly, in a certain point of view, laws can be simply separate into fairness and unfairness. On one hand, somelaws which are enacted to restrain peoples' behavior which will possibly harmother individuals, the populace and keep the stability of the society aresurely fair to every individual and govern a society and the like. Forinstance, a rule “No Smoking in Public Place” has been fully applied everywhere to preventa potential accident such as fire disaster. Since “No Smoking” was adopted, alot of fire disasters which might happen in classy joint have been successfullyprevented and protect people who are possibly hurt in such kinds of accidents throughrestricting peoples’ bad habits of smoking in public place. So many laws, suchas traffic law and criminal law, which are similar to what mentioned above, function to control the behavior of members in society.
On the other hand, it is so unfair for someconflicts resulting from those who protect their own interests against beinginfringed that they cannot be judged justifiably. Consider, for example, a lawthat regulates the sulfur dioxide a certain factory can emit to the air so asto bring about the pollution nearby. Such laws are enacted mainly to protectthe environment and public health. But complying with the regulation will be costlyfor the factory. To compensate for the cost of compliance, the leader has tolay off employees to reduce the products, or increase the price of its productsin stead. At stake are the respective interests of the factory’s owners, employees and customers, as well as the opposing interests of the region’sresidents who are impacted with their health and safety. In short, some lawswhich fail to protect two or more sides’ interests in a conflict are otherwiserecognized as unfair at all.
It is undoubted that to obey judicial lawsis, of course, is a common sense for people. Yet, when judged by equitable laws, some behaviors such as disobey, resist even challenge the authority of laws areotherwise lack of reason and would be severely punished. Moreover, without retaining from these assumptions, by justifying a violation of one sort of law it is frightful for us to slip slope toward sanctioning all types of illegalbehavior, such as frightening criminal conduct. To better improve the justiceof laws, people who were judged unjust should offer proposals to the justicedepartment and certainly they will pay attention to these unjust laws, perhapsthey will adopt your ideas and reform this type of laws more equitable to everyindividual.
In sum, we need to reach an agreement thata just law is worthy of obeying, while improve other unjust laws by effectiveand secure measures other than disobeying it.
