Issue 18
There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws.
分两个社会来说:
非民主社会 封建社会 君主制:不公平的法律 为特权阶级 民众应该反对、甚至推翻政权
民主社会法律只有适合以及不适合的法律民众的最大利益就是国家的最大利益为了保持国家的安定繁荣内部矛盾要以平和的方式解决
It is rather alluring to agree with the speaker’s assertion at first glance that there are only tow ways for commom people to deal with laws: for those just laws, any individual should comply with; for those unjust laws, one should disobey and resist. In deed, one would not doubt about obeying just laws, however, peopole could find a more proper attitude toward unjust laws in order to adjust it into laws with equity in favor of the majority’s interests.
A threshold problem with the assertion that the speaker take no account of the disparity in system of government. Especially in undemocracy country, considering the despotic rule of the dictator of a moarch, there is no chance for common people to amendment, not to say legislate. The most effective approach for making just laws for the interests of people, not those in power, is to rise up against the dictatorship and then establish a democrocy government; through peaceful demonstration, not only problems won’t be solved but people would put their valuable lives in danger, and the whole incident would end up with a more brutally repression.
Human history is replete with ample examples to prove the efficiency of insurrection against oppressors. Take Soviet Union as an example, in which people had overthrown the Russian monorche in 1917, and through a second revolution created the world’s first Communist state. Cuba and China had succesively built up Communist government through violent civil war. Although there were many heroes had been perished with the merciless war, a country and a government for labor class had been built. One can say that sacrifices are necessary while fighting with unjust laws.
On the contrary, people under government of democratic country should take no consider of such severe solutions like those oppressed by dictatorship, in that no fundamental conflict between governors and people. The legislation procedure in itself proves that there is no just and unjust laws in democracy, only proper or inproper, which would adjust through amendment. For instance, Amerian national government has a system of checks and balances as an effective solution to maintain the principle of democracy. The three branches of government—the legislative, the executive, and the judical—restrain and stabilize one another through their separated functions.
Furthermore, one should take an objective stance toward laws regardless the seems-like just ligislative procedures. Considering the high speed the society and market change, modification of laws should be conducted in time. The policy of family panning has been cunducted almost 2 decades in mainland China, for controlling the recreasing population. However, some debuties propose a bill of suspending the family planning by pointing out that one child policy is becaming a social problem in this year’s National People’s Congress. No matter whether or not the proposal would be adopted, this matter of fact prove that laws in democratic society is not just or unjust but out of or keep up with time.
To sum up, the justice of laws and the attitude of people toward them should be regarded under different societal background. Only if the unjustice was caused by class conflicts, a violent riseup would come into effect. Otherwise, a mild treatment towards out-of-time laws is much more favorable to solve problems.
