TOPIC: ISSUE17 - "There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws."
WORDS: 626 TIME: 0:40:00 DATE: 2007-2-28
There is no denying that, laws play vital roles in sustaining the harmony democrat society. They have already taken roots in a free nation's heart. In nearly every field, without laws the daily operations can hardly process. Even a tiny change in a law may bring about great turmoil in a certain realm. Therefore, any action or even classification towards law should after cautious and rational deliberations, for the extreme intricate characters the laws own.
We have long been entangled in the web of whether a law is just or not. Such deadlock confuses us almost since the birth of the law. The judgments towards the same law may be various, from different angle, and at different times. Take, the Prohibit for an apt illustration, from the government's opinion, such ban obviously permitted the citizens more healthy lives, while the public, especially those youths, held the completely opposite ideas, which finally made the Prohibit unenforceable. Another example may be the ban on transplant of organs in other countries decades ago. Although those conservative people seriously disagreed with and published laws against the organ transplant when the technology firstly was developed, it is widely accepted nowadays as a normal treatment, like taking a cold pill. Laws are too complicated to simply be divided into two types such just and unjust. Many problems existed in laws are at the margin, so it is nearly impossible to assert fairly whether it is just or not. These inevitable problems occur not coincidently, for laws should meet the overall demands of the society, which calls for a balance between the benefits of each class. Therefore, while no one can have the maximized profits, complaints about certain laws are not difficult to understand. In fact, nearly no laws are considered to be just by everyone of the society at any time. Laws cannot please everyone.
However, when it comes to problems in laws that are way too apparent and pernicious, it is indeed the public's task to protest such unjust laws, but violent actions should be taken place by rational and calm protests or infighting, if the overall law system in the country at that time is still reliable. In such cases the problems of the laws can be adjust in the legal realm, not through criminal behaviors. Take, Martin Luther King, for example, he took the non-violence campaign towards the racial discrimination laws rather than provoke the dangerous spirit and anger of the blacks. And finally, their assertion was understand and accepted by the mainstream of the American whites, and thus those laws have been modified greatly although not thoroughly. It is not hard to imagine that if King and his black brothers took illegal actions towards the unjust laws, the ultimate results may completely counter their original goal, that is the mayhem of the American society, and a even deeper gap between the black and the white. As long as the laws exist, there may be wrongs, and if no man rebels in a proper way, these wrongs will last forever.
Sometimes the whole law systems are controlled by the autocrat, so it has already become the govern tools of those non-democrat leaders. Lacking the free and democrat spirit as the foundation, the problems of the law have not limited in the legal system itself, but the whole laws are unjust. Those ultimate unjust laws cannot be adjusted, but only can be overthrown. Then comes the violent revolutions, and then a new order in the country can be established, just as the Great Revolutions did in France in 1800s. Just confine our action to modify the unjust law in the circle of the unjust law system is stupid.
In summary, laws are the cornerstone and permission of the society. |
