When the Enron case broke, many business bashers jumped at the chance to blame deregulation for the mess. The same had occurred when California started to experience blackouts and hikes in energy costs last year.
Indeed, following some mild moves in the direction of a genuine free market in many parts of the globe and even here in the USA, a lot of well- positioned commentators with clearly statist sentiments experienced near-panic. Indeed, there might be, after decades and decades of sliding toward broader and broader scope for government authority in our lives, some retreat of state power in the offing. This, obviously, couldn't be allowed.
So, one way to attempt a reversal of the rather mild trend toward privatization and deregulation is to begin to blame everything on freedom. And one plausible spin would be to declare that corporations are no different from rouge states, in need, therefore, of the heavy hand of benign government regulators.
In the back of some of these desperate efforts -- to stem any advance toward greater individual liberty in human community life -- is a lesson that might otherwise be missed. It is that when the state does gain widespread intrusive legal authority in the lives of the citizenry, the citizenry will begin to be guided not by its moral conscience and common sense but by the sole consideration of whether what people are doing is OK with the law-makers. Some corporations, for example, declare up front that they are not interested in business ethics -- which they take to vary from culture to culture -- but only in the law. (Which probably is what accounts for the prominence of legal departments at most corporate headquarters.)
But the problem extends farther than business. Recently in Orange County, California, the American Red Cross sponsored an event at a privately owned hotel to which a group of high school students had been invited to sing. Having learned that the singers would belt out some songs that had religious content, the Red Cross folks decided to demand that these be removed from the program, probably figuring that such would be the PC and legally harmless thing to do these days. And as much as this outraged a great many people in the community and ultimately led the Red Cross to issue an apology, what transpired made some kind of perverse sense.
When activities are carried out or supervised by the legal authorities, the principle that no special favors must be extended is the rule. Under the law, everyone must be treated the same, without regard to religion, color, national origin, and other special attributes. It is this idea that animates the 14th Amendment to the U.S. Constitution and, indeed, the rule of law itself.
The reasoning behind this is rather straightforward. The law governs us all as human beings who live in human communities. So, it is only our common humanity that must come into play as far as the law is concerned, nothing special about us. If one must not kill, assault, kidnap or rob others, that applies simply by virtue of being human not because one hails from Japan or has dark skin pigmentation. That is one reason why segregation, dictated by the laws of various Southern states, was so clearly unjust. That is why even when it would appear to make some sense, racial profiling is a very dubious police practice. That is why sexual or ethnic discrimination by governments is to be forbidden.
But there is a conflict between this unexceptional idea and the widening of the scope of government power. When we get away from the simple negative principles of a just human community -- don't kill, don't assault, don't rob, don't rape and such, meaning, basically, that we should all live together peacefully -- and start regimenting the details of human life, people are no longer similar at all, quite the contrary. Maybe some should and some should not smoke. Maybe some should and some should not go to church. Maybe some should and others should not paint certain kinds of pictures or play certain sports or purchase SUVs or talk with the animals. Only at some very basic level are we all -- or virtually all of us -- alike. We become differentiated rather quickly as it concerns the details of our lives -- some are parents, some teachers, some tall, some women, some young, some athletes, some Roman Catholics, some Jews, some Moonies and some even agnostics or atheists.
Well, in a community that respects -- and has made provisions for the protection of individual rights -- the diversity of human life has nearly free reign. Just look around America and this becomes evident! If now government tries to apply its principles of equal protection under the law to all the different areas of human activity that can arise in a highly diverse society, the task will be impossible and nearly totalitarian. If the American Red Cross acts, then, like a quasi-government, making its program suited to everyone equally, it will find itself unable to do anything even mildly special, let alone controversial. But if its programs are carried out for the general public, it could become concerned about whether to conform to the spirit if not the letter of the law. It may not have to but it may still consider it politically prudent to do this.
This is how we begin to leave our common sense and try to make practices adjust to some artificial one-size-fits-all vision of community life that, in fact, fits no one at all. But once education, recreation and athletics -- to list but a few things people do in life -- become quasi-government affairs, they cannot be differentiated based on different needs of different segments and members of communities. They gradually become the same, or at least pretend to be such, so as to accommodate the now impossible ideal of the now highly intrusive rule of law.
Not only will this generate completely artificial practices and bans but it will also take our minds off what is really important, namely, figuring out on our own how we should conduct ourselves in our lives. We now will be inclined to focus not on morality or ethics but on public policy and law. That is quite understandable, since when law and public policy are not heeded, severe consequences can ensue. We can be found to be law-breakers, which brings about costly sanctions. You smoke in a pub now and this means going to court, paying fines, putting your life on hold. You offend some group and spend years in court!
The American Red Cross officials may perhaps not be fully forgiven for losing their common sense but it is at least understandable why they worried so much about being politically correct. With religious songs at an event open to the public, they would risk bringing down upon them the wrath of the American Civil Liberties Union if not immediately the local police.
A society where laws have become the answer to all human problems, laws get completely confusing and many people begin to be concerned with nothing other than avoiding violating the law. Such a society is very likely to see ethics and morality slowly but surely recede from its midst.

Enron Was a Favorable Event - Issues and Answers to Make Business and Capitalism More Competitive.

         一直以来,Enron 身上都笼罩着一层层的金色光环:作为世界最大的能源交易商,Enron在2000年的总收入高达1010亿美元,名列《财富》杂志“美国500强”的第七名;掌控着美国20%的电能和天然气交易,是华尔街竞相追捧的宠儿;Enron股票是所有的证券评级机构都强力推荐的绩优股,股价高达70多美元并且仍然呈上升之势。直到破产前,公司营运业务覆盖全球40个国家和地区,共有雇员2.1万人,资产额高达620亿美元;Enron一直鼓吹自己是“全球领先企业”,业务包括能源批发与零售、宽带、能源运输以及金融交易,连续4年获得“美国最具创新精神的公司”称号,并与小布什政府关系密切……

        Enron的噩梦

        2001年年初,一家有着良好声誉的短期投资机构老板吉姆·切欧斯公开对Enron的盈利模式表示了怀疑。他指出,虽然Enron的业务看起来很辉煌,但实际上赚不到什么钱,也没有人能够说清Enron是怎么赚钱的。据他分析,Enron的盈利率在2000年为5%,到了2001年初就降到2%以下,对于投资者来说,投资回报率仅有7%左右。

        切欧斯还注意到有些文件涉及了Enron背后的partnerships,这些公司和Enron有着说不清的幕后交易,作为Enron的首席执行官,斯基林一直在抛出手中的Enron股票———而他不断宣称Enron的股票会从当时的70美元左右升至126美元。而且按照美国法律规定,公司董事会成员如果没有离开董事会,就不能抛出手中持有的公司股票。

         也许正是这一点引发了人们对Enron的怀疑,并开始真正追究Enron的盈利情况和现金流向。到了8月中旬,人们对于Enron的疑问越来越多,并最终导致了股价下跌。8月9日,Enron股价已经从年初的80美元左右跌到了42美元。

         10月16日,Enron发表2001年第二季度财报,宣布公司亏损总计达到6.18亿美元,即每股亏损1.11美元。同时首次透露因首席财务官安德鲁·法斯托与合伙公司经营不当,公司股东资产缩水12亿美元。

          10月22日,美国证券交易委员会瞄上Enron,要求公司自动提交某些交易的细节内容。并最终于10月31日开始对安然及其合伙公司进行正式调查。

          11月1日,Enron抵押了公司部分资产,获得J.P摩根和所罗门史密斯巴尼的10亿美元信贷额度担保,但美林和标普公司仍然再次调低了对Enron的评级。

11月8日,Enron被迫承认做了假账,虚报数字让人瞠目结舌:自1997年以来,Enron虚报盈利共计近6亿美元。

11月9日,迪诺基公司宣布准备用80亿美元收购Enron,并承担130亿美元的债务。当天午盘安然股价下挫0.16美元。

11月28日,标准普尔将Enron债务评级调低至“垃圾债券”级。

11月30日,Enron股价跌至0.26美元,市值由峰值时的800亿美元跌至2亿美元。

12月2日,Enron正式向破产法院申请破产保护,破产清单中所列资产高达498亿美元,成为美国历史上最大的破产企业。当天,Enron还向法院提出诉讼,声称迪诺基中止对其合并不合规定,要求赔偿。

     Enron模式的破产

     首先遭到质疑的是Enron的管理层,包括董事会、监事会和公司高级管理人员。他们面临的指控包括疏于职守、虚报账目、误导投资人以及牟取私利等。

      在10月16日Enron公布第二季度财报以前,Enron的财务报告是所有投资者都乐于见到的。看看Enron过去的财务报告:2000年第四季度,“公司天然气业务成长翻升3倍,公司能源服务公司零售业务翻升5倍”;2001年第一季度,“季营收成长4倍,是连续21个盈余成长的财季”……在Enron,衡量业务成长的单位不是百分比,而是倍数,这让所有投资者都笑逐颜开。到了2001年第二季度,公司突然亏损了,而且亏损额还高达6.18亿美元!

      然后,一直隐藏在Enron背后的合伙公司开始露出水面。经过调查,这些合伙公司大多被安然高层官员所控制,Enron对外的巨额贷款经常被列入这些公司,而不出现在安然的资产负债表上。这样,Enron高达130亿美元的巨额债务就不会为投资人所知,而Enron的一些官员也从这些合伙公司中牟取私利。

      更让投资者气愤的是,显然Enron的高层对于公司运营中出现的问题非常了解,但长期以来熟视无睹甚至有意隐瞒。包括首席执行官斯基林在内的许多董事会成员一方面鼓吹股价还将继续上升,一方面却在秘密抛售公司股票。而公司的14名监事会成员有7名与Enron关系特殊,要么正在与Enron进行交易,要么供职于Enron支持的非盈利机构,对Enron的种种劣迹睁一只眼闭一只眼。

      Enron假账问题也让其审计公司安达信面临着被诉讼的危险。位列世界第五的会计师事务所安达信作为Enron公司财务报告的审计者,既没审计出Enron虚报利润,也没发现其巨额债务。今年6月,安达信曾因审计工作中出现欺诈行为被美国证券交易委员会罚了700万美元。

       Enron的核心业务就是能源及其相关产品的买卖,但在Enron,这种买卖被称作“能源交易”。据介绍,该种生意是构建在信用的基础上,也就是能源供应者及消费者以Enron为媒介建立合约,承诺在几个月或几年之后履行合约义务。在这种交易中,Enron作为“中间人”可以很短时间内提升业绩。由于这种生意以中间人的信用为基础,一旦Enron出现任何丑闻,其信用必将大打折扣,生意马上就有中止的危险。

        此外,这种业务模式对于Enron的现金流向也有着重大影响。大多数Enron的业务是基于“未来市场”的合同,虽然签订的合同收入将计入公司财务报表,但在合同履行之前并不能给Enron带来任何现金。合同签订得越多,账面数字和实际现金收入之间的差距就越大。

        Enron不愿意承认自己是贸易公司,一个重要的理由就是为了抬升股价。作为贸易公司,由于天生面临着交易收入不稳定的风险,很难在股市上得到过高评价。Enron鼎盛时期的市值曾达到其盈利的70倍甚至更多。

为了保住其自封的“世界领先公司”地位,Enron的业务不断扩张,不仅包括传统的天然气和电力业务,还包括风力、水力、投资、木材、广告等等。2000年,宽带业务盛极一时,Enron又投资了宽带业务。

如此折腾,Enron终于在2001年10月在资产负债平衡表上拉出了高达6.18亿美元的大口子。

破产余波难平

在Enron破产事件中,损失最惨重的无疑是那些投资者,尤其是仍然掌握大量安然股票的普通投资者。按照美国法律,在申请破产保护之后,Enron的资产将优先缴纳税款、赔还银行借款、发放员工薪资等,本来就已经不值钱的公司再经这么一折腾,投资人肯定是血本无归。

投资人为挽回损失只有提起诉讼。按照美国法律,股市投资人可以对安达信在财务审计时未尽职责提起诉讼,如果法庭判定指控成立,安达信将不得不为他们的损失做出赔偿。

在此事件中受到影响的还有Enron的交易对象和那些大的金融财团。据统计,在安然破产案中,杜克(D uk e)集团损失了1亿美元,米伦特公司损失8000万美元,迪诺基损失7500万美元。在财团中,损失比较惨重的是J.P摩根和花旗集团。仅J.P摩根对Enron的无担保贷款就高达5亿美元,据称花旗集团的损失也差不多与此相当。此外,Enron的债主还包括德意志银行、日本三家大银行等

Laws are the princile of the whole society and everyone should obey the laws regardless of status, color, religion or any other special attribute. Here comes to a problem. Different cultures have different principles, it is almost impossible for the whole world to apply to one single principle. That causes conflicts in contemparary world when globalization beomes a transparent trend and people from different culture come together in a community. How should the law play its role in such a situation?

It's true that people are different from each other so that everyone might have his or her own life princiles. Maybe some should and some should not smoke. Maybe some should and some should not go to church. Maybe some should and others should not paint certain kinds of pictures or play certain sports or purchase SUVs or talk with the animals. However, at some very basic level are we all -- or virtually all of us -- alike. We all care about freedom and life. We all focus on food, living, education and so on. Laws should protect the rights of these basic demands. As for the diversity among people, local laws should be in effect.

用简单的词汇来表达意思是挺重要的技能呢。
如果你有时间,可以拿一本新概念,把一篇中的好短语和好句型划出来,并应用它们写成一篇文章;长期来说,我觉得这是提高书面表达能力的相当快的方式了。

fraught with, electic, explicit, counterpoise, facinate

The other day when I was fraught with my unfinished papers, one of my friends invite me to go to see the popular 3D film Avatar. I did think that the enjoyment from the film would be a counterpoise to my gloomy mood. However, there was another problem to solve, that is, I did not have enough money by hand. Then my friend suggested that he treat me this time and I can treat him a dinner the next semester. I believed that was an electic choice, so I agreed. When we got to the cinema, each of us was offered a special pair of glasses which is specially for watching 3D films. Also there was an explicit instruction which warned that if we broke the glasses, we would have to pay for it. Avatar is facinating and wonderful! What I nice day!~

争取高分,从第一印象开始---被人忽视的argument开头

浪迹作文版也有差不多快3个月了,不断的从前人那里拿出资料和心得来充实自己而不主动的贡献一点东西,时常也有那么一些“不劳而获的感觉真好,难怪贪婪是罪”的想法。然而3个月的100 percent的准备,(我相信这个时间跨度比这里绝大多数板油的准备GRE时间还长了) 也让我有了不少的个人心得,我一直认为,有了想法却窝藏是一件很浪费的事情,我们的爷爷的爷爷的爷爷….说的好:“一个想法的分享,等于千万个灵感的诞生”。我不敢说下面我要写的东西究竟符合ETS的兴趣与否 --- 实际上ETS的兴趣到底是什么,到底喜欢怎么样的文章,到底扣分都扣在什么些地方,我想除了ETS自己,没有任何人能够说的清楚 --- 然而作为弱势群体的考生,哪怕只有1%的可能性被扣分,也应当付出100%的努力去避免,这个才是取胜和高分之道,同时也期望着各位看了我的这些想法以后,对Argument能有一些启示,那么我就真的没有白写这么个东西。

陆陆续续的Argument也写掉了20来篇了,从最开始的照着范文写直到抛开范文红着脸来憋,每一个字感觉都是一种折磨,再到现在头痛时间的问题,一些很有趣的问题就在我脑中不断的盘旋和缠绕,其中的第一个就是开头问题。如何开头?如何在短的时间内吸引到阅卷人的良好印象?曾经当我在对如何下笔开始argument一筹莫展之际,翻遍了AW精华区,也没有找到答案,当时一度令我很沮丧:大家都不屑于讨论的一个东西,居然就把我给难倒了,我也别去考什么GRE了,回家去农妇山泉有点田吧。直到最近当我回头,总结掉我所写过的所有argument以后,我才发现了一个草率的开头可能是绝大多数XDF型同学们忽略掉的一个最大的扣分点。

一个开头对于行文有什么帮助?Argument的开头到底要表达一些什么信息?开头,类似于每一段话的TS一样,应当是全文的TS,一个好的开头不仅能够让ETS老师迅速的抓住你的思维结构和逻辑论证过程,而且能够使自己的下文论述更加充分。很多同学都会在不知不觉当中发现自己的论证开始偏离题目的要求,尤其是在举出可能性的时候,经常有的可能性让人一头雾水,或者让人感觉到过于极端,这就是没有一开始就理顺文章的逻辑的结果。如果我说:argument开头是最不能忽视的,我想,经过了XDF洗脑的同学们第一时间就会呸我两口:开头结尾一共写5分钟,照着模板套套写完就行了,哪里用去想?然而,大错特错。 先不要着急扔鸡蛋,为了弄清楚这个问题的实质,我最近拾起了让我最反胃的模板,仔仔细细的研究了一番它们的开头。给我的结论是:一无是处

常见的模板开头一般是两种类型:

1直截了当,这种模板通常的方式就是 In this argument, the author concludes that… however, it suffers from several logical flaws. 简单实用吧,然而,除了告诉阅卷人:我开始行文了!以外,这种开头还有别的用处么?ETS的老师批的头晕脑胀四肢发慌的时候,流水线一般出现在他面前的居然是几百几千份这种工厂里面出来的开头,看着就倒胃口的压缩食品,他会怎么想?“你说的东西没错,但是除了几个单词以外,实在是看不出什么内容,真TM恶心。”估计当时给你的文章档次就压了一级。更何况,ETS提倡的是思维的展现,不是你打字的速度,更不是你抄写的能力,这种开头如何能够配得上高分?可笑的是新东方的老师们,一遍一遍的强调着:开头要简洁,一句话足矣,时间用的越少越好。来给广大的中国考生洗脑,被洗脑的考生们又把这种思想开始淳淳善诱师弟师妹们,造成了现在的普遍的错觉:开头不重要。时代在变化,ETS 的胃口也在变化,然而这种理念持续了足足有8年之久或者更长,却从来没有变过。无怪乎最近两年的AW成绩普遍的开始下降,细小之处就能看出端倪来。

2固定逻辑式,这种模板的表述一般来说是:In this argument, the author concludes that… To support the conclusion, the arguer points out that … and provides the evidence that … A careful examination of this argument would reveal how groundless the conclusion is.
对于这类型的开头,从本意来看,比第一种强多了,但也会是最大的败笔之处。因为令人遗憾的是,绝大多数的同学们使用这种开头的目的,不是为了理清楚题目的逻辑关系,而是为了凑字数,他们忘记了思考,一种务必要贯穿整个写作过程的speculation. 为了方便的说明我的观点,特地找了一篇这样的模板型开头,感谢flyex童鞋.

38.Thefollowing memo appeared in the newsletter of the West Meria Public Health Council.

"An innovative treatment has come to our attention that promises to significantly reduce absenteeism in our schools and workplaces. A study reports that in nearby East Meria, where fish consumption is very high, people visit the doctor only once or twice per year for the treatment of colds. Clearly, eating a substantial amount of fish can prevent colds. Since colds are the reason most frequently given for absences from school and work, we recommend the daily use of Ichthaid, a nutritional supplement derived from fish oil, as a good way to prevent colds and lower absenteeism."


In this argument, the arguer concludes that daily use of lchthaid will help people to prevent colds and lower absenteeism. To support this conclusion, the arguer cites the evidence that in East Meria, people seldom to the hospital for the treatment of colds because of the high consumption of fish in that place. Carefully examination of this supporting evidence, however, reveals that it lends little credible support to the arguer’s suggestion.

我想,很多童鞋当写完这么一个开头的时候,下了考场自我感觉都会非常的良好,觉得4分在手了,内容写的稍微全面一点的话,5分也不在话下,那么我现在告诉大家,这样的开头,其实是彻底的失败,从内容表达上来说,这个开头只值3分或者更低。不信?看我接下来的说法。

我们先来分析一下文章的结构:(à表示推出)
A study reports that in nearby East Meria, where fish consumption is very high, people visit the doctor only once or twice per year for the treatment of colds
通过这句话,我们能够发现作者的第一步推理:study reports(已知) à EM的人为感冒而看医生较少是 indeed exist.(推理1 à EM的人感冒少(推理2
Clearly, eating a substantial amount of fish can prevent colds.
这句话可以得出第二部推理:这种现象(推理2+ 鱼类消费高(事实1 à 鱼类对这种现象有帮助(推理3 à 鱼类的某种物质对抑制感冒有帮助(推理4
Since colds are the reason most frequently given for absences from school and work, we recommend the daily use of Ichthaid, a nutritional supplement derived from fish oil, as a good way to prevent colds and lower absenteeism."
然后下一个推论:感冒是主要的旷工借口(事实2 à 感冒是主要的旷工原因(推论5+ 推论4 à 鱼类的某种物质可以抑制感冒,减少旷工。(推论6à 鱼油中提炼的营养品可以抑制感冒,减少旷工(推论7
最后是结论:推论7 à 吃这种营养品可以预防感冒,减少旷工(结论)

实际上,是这么多步奏的推论和隐含前提的共同作用,才得出这么个荒谬的结果,而上面那位童鞋仅仅把得出结论的原因归咎为:the evidence that in East Meria, people seldom to the hospital for the treatment of colds because of the high consumption of fish in that place. ETS老师看到这样的开头的时候,第一个反应估计就是:这个人题都没读懂就开始瞎写。自然后面的评价不会高到哪儿去。

那么,一个好的开头究竟应当有些什么内容?

正如我上文提到的,开头的最大的作用应该在于帮助写作的时候理清文章的脉络,一个好的开头应该就是一个文章的缩影,应该给阅卷的老师三个直观的印象:1. 这些逻辑点确实是来自于文章的抽象2. 这个学生抓的逻辑点都是正确的。3.从这些逻辑点的顺序当中可以猜测到该生的正文论证顺序。

仍然举上面那篇argument为例子,当最开始看到题一步步阅读的时候,脑子里面就应该开始抽象出一些作者的推论了,或许大家都不能第一遍看完就列出我上面写的那么详细的多步推论,(就连我自己也不行)然而,大概的推论过程应该在你的脑子里面很清醒的展现出来,比如类似这样的缩略版:

Study à 感冒的人少
感冒的人少+吃鱼多 à鱼里面有物质对感冒有效
鱼对感冒有效+感冒是第一请假理由 à 吃鱼油可以避免请假

我想,在短短的1分钟内,能够理论这么一个思路,就足够了,ETS的老师也明白你不可能再30分钟的时间里面面俱到,但是你有了这样的思维,至少就和其他的上来就开始套模板的开头不一样了,接下来我们可以这样开头:

Grounding on the study in East Meria, supposing that eating a substantial amount of fish can prevent colds, and then synthesizing the two hypothesizes and another factor that colds are the reason most frequently given for absences from school and work, the author accordingly suggests that the daily use of Ichthaid is a good way to prevent colds and lower absenteeism. However

类似这样的开头,首先并不花时间,因为除了一些连词和动词以外,大部分都是照抄原文,经过简单的练习以后,绝对能够在3分钟之内搞定,然而,它的价值却比模板高的多。当ETS拿到这么一个开头的时候,首先他必然会对你的综合能力感到满意,因为这些逻辑关系,的确是文章当中提到的,也是顺理成章的关系;其次你在这样一个开头里面传达了一个信息:我接下来要批的东西,已经都在这个开头里面啦。老师们都是很有经验的,很容易就能看出你这篇A,主要批的是三个东西:1.study的真实性,代表性或者全面性, 2. 那个supposing的合理性, 3.综合结论的谬误。接下来他们在读你的正文的时候,自然而然会有一种感觉:这个学生的逻辑性不错,至少段落之间,是绝对没有问题的,因为他的开头已经告诉了我,他的批判是按照逻辑来的

我没有想过提供更多可借鉴的东西,更不希望大家把我给的那个开头的例子总结成某个新的模板,我更希望通过这篇不算太长的文章传递一种新的,有别于XDF的思想,模板是我一直痛恨的东西,机缘巧合之下我也没有去成XDF,算是我的不幸,因为我必须用比别人更长的时间来入门,也算我的幸运,因为我的内心深处的思想是自由的,没有受到任何拘束。当我写的文章多了,我自己也有了固定的表达方式,我不知道这算不算是我的模板,会不会阻碍我的进步,但我知道自己在不停的思考,不停的试图从每一微小的方面提高,满足ETS那变态的要求。常言道:“授人以鱼不如授人以渔”,不可否认,新东方和一些其他的陈旧思维在速成和入门方面,的确是做出了不可磨灭的贡献。然而,写作是一门艺术,端正写作的态度更是一种财富,当大家都开始蜂拥的追求更快更方便的途径的时候,ETS关闭了高分的大门,唯有不停的思考,不停的总结,才能够返璞归真,真正懂得:考试的目的不是折磨人,而是一种化蝶前的蜕变。
