Law is the system ofrules set up by the authority to regulating theactions of its members and keep balanced order of the society. However,even the most advanced civilization indeed has large numbers of citizenscomplain about so-called unjust laws. How can we distinguish just laws fromunjust laws? In my opinion, there is no distinct conception between just andunjust laws and we should obey once the law is enacted by the government torespect the society's order.
First and foremost, we should make clearthe boundary between just and unjust laws, whereas it is difficult. In mostcases, people tend to judge a law based on their own ethical and moralstandards, which vary from person to person, country to country. One aptillustration involves the case of homosexuality, which is distained by somecountries as they violate the traditional view towards sex and marriage.However, some nations justify love between gays and make their marriage legal,regarding it as the milestone of democracy and freedom. People in these nationsemphasize their human rights and think that they have the freedom to choosewhatever they want. Also, euthanasia, which is one of the most controversialissues in world, is forbidden by law in many countries. They are hard toimagine a doctor just standing beside a dying person while doing nothing. Lifeis invaluable and should not be given up. On the contrary, in Switzerland forinstance, people accept this phenomenon as they can assuage patient's pain bygiving them euthanasia, and finally made it legal. Therefore, certain affairwhich is illegal in one country may be justifiable in another country. There isno universal boundary between just and unjust laws. It is how we perceive themthat make a difference.
Furthermore, if people freely violate thelaw they believe unjust as frequently as possible, the social order can begreatly disturbed. Laws for taxation are universally enacted in most countries.One of the main characters is taxing according to how much one earns, which isgenerally regarded as the redistribution for the sake of trying to help thepoor. For example, it is said that, Bill Gates, once the wealthiest man, couldearn 150 dollars per second. He should pay much more tax than any other peopleto satisfy the law as a result. However, some Liberians are against this law,saying that if money is obtained through legal way, why should they pay moremerely because they earn more? Actually, they should fully acknowledge that thewealthier they are, the more they benefit from the society and they have moreresponsibilities to help the poor. Most importantly, if one person initially doesnot pay sufficient tax, how can we expect others to pay? In this way, thesocial order can be violated as no one would like to pay tax. Lacking financialsupport, any country is unable to develop, and the aid for the poor cannot beguaranteed. Laws, which are established to keep order, have their reason for existenceand should not be disobeyed, otherwise render the society restless.
For the final analysis, laws are made byhuman beings, fallacies cannot be avoided. Once enacted, as ordinaryindividuals, we should not violate the law as we wish. If we regard it asunjust, suggestions should first be offered to senators or representatives andamend the law through legal process. By this I mean, it is not wise for us totake extreme measures to counter what we consider unjust. If our suggestion isreasonable and supported by the majority, the law will naturally be amended. Ifnot, then our definition of unjust law is not accepted by the mainstream. Afterall, government is the ultimate lawmaker which should consider the overallwelfare of its citizens on the whole and the stubborn violation seemsirrational.
To sum up, it is hard to define what justlaw is and what unjust law is as different persons and countries may havedifferent view towards it. What’s more, every law has its merits in keepingpositive social order which we should by any means respect. Besides, if weinsist certain law as unjust, what we should do is put forward our reasonablesuggestion and wait for the government, the lawmaker, to solve it. |
