Some people believe that there should be fixed punishment for each type of crime. Others, however, argue that the circumstances of an individual crime, and the motivation for committing it, should always be taken into account when deciding on the punishment.


The punishments of crime are fixed, which is good or not? It is generally indicated that the punishments for different types of crime should be fixed, while others argue that deciding on the punishment must base on the circumstances and motivation of a crime as a whole. Weighing the pros and cons of the both two sides, I believe every view has its own reason. However, in my opinion, I suppose that different crimes should be judged in different punishments.

It is obviously that the dangers of different types of crime are different. For instance, a thief can just stole some money and things, but a murderer can kill somebody, both the circumstance and motivation are different. If the punishments were fixed, it would be terrible for social fair and stability. In order to punish each type of crime in appropriate punishments, the government and the law maker establish a multitude of complete laws in terms of social system. A recent investigation conducted by the Chinese Academic of Social Sciences revealed that more than 1,000 laws have been established from 1949 to 2010.

However, as a matter of fact, the efficiency of court is really low because of the complicated course of judge. It is no longer a problem for court, but for society as a whole. Fixed punishment can save a lot of money, which will mainly benefit all members of society. But overall, it can also cause a damage for justice.

By way of conclusion, I once again reaffirm my position that the judge must decide whose punishment base on the circumstance and motivation. Only in this way can we maintain a fairly and stable society.
