再请教关于OPT的问题

再请教各位大牛：

对理工生来说，有29个月甚至更多的OPT的时间。如果读第一个Master时申请了OPT，那么再次读另一个Master就不能再申请。但是如果第一次申OPT只用了10个月多一点，那么剩余还有近19个月的OPT资格就自然取消了吗？第二次读Master就不能申请剩余的月份的OPT了吗？

首先，这个问题希望你咨询你学校的IS，或者咨询移民律师，这种重要事情不要问道于盲，何况一般学校IS也不收你钱。

我大概说一下我的看法：
你首先要master，然后拿12个月的OPT，然后后面申请extention获得额外的时间，这三个是有一定的顺序的。
你已经拿了一个master，并且使用过了OPT，那么虽然你这个OPT没有用满，但是一般认为你第二个master就已经拿不到OPT了（虽然有人说OPT可以分开使用，但是这个东西变数比较大，你倒是可以尝试一下）；如果你第二个硕士之后拿不到OPT，那么也就无从谈起extention了。那么这种情况下你的选择，要么申请phd，phd毕业之后你还可以继续有OPT，并且可以继续使用extention。或者CPT挂靠那种东西我就不教你了。
当然，如果你运气比较好，argue成功了，移民局同意你继续使用你剩余的那一点OPT（which is not gonna be easy)，你最后也成功在剩余的这点时间截止之前找到愿意帮你办extention的公司，那么理论上是可以extention拿到这剩余的19个月时间的。

以上回答很可能有问题，我本身还没有入学，只知道这么点了。

"Can I split up my OPT into multiple segments?

You are eligible for only one post-completion OPT segment per completed program of study.  You must begin post-completion OPT within 60 days of your program end date.  Any OPT you do not request or use will be forfeited.  At the same level, you can split post-completion OPT into multiple sections ; for example, you can use six months of OPT after completing a master’s program in computer science, and use the remaining six months after completing an MBA.  However, if you choose not to apply for OPT at the time you complete a program, you cannot go back at some point in the future and claim that OPT time.  In this sense, OPT is a ‘use it or lose it’ proposition.

You can apply for multiple segments of pre-completion OPT; for example, you can use pre-completion OPT during two separate summers while you are a student for an internship or job.

The only way to extend your post-completion OPT is by using the STEM or H-1 Cap Gap Extension (if eligible)."

还有，我之前问过学校ISSS关于split OPT的事：
I received my MA degree on February 1, and I’ve applied for OPT starting on March 31, 2016 and ending on March 30, 2017. The current application status is “Case was transferred and a new office has jurisdiction”. However, I’ve also been accepted by a MS program from another university. I know there is only one OPT for each degree level, but is it possible to split my OPT into two? That is, I use several months for my current MA degree, and some for the future MS program. Is it still possible to change the OPT end date for the current degree from March 30, 2017 to, say, May 30, 2016?



学校的回复是：
The only way this is possible is if you had applied for less than one year of OPT on your application to USCIS. At this point, USCIS will approve one full year of OPT, and you will not be able to split it between two Master’s programs. Even if you decide not to use your entire year of OPT, once USCIS approves one full year, you are not able to reserve part of it to use after a later degree.

The only possible way for this to happen now is if you were to withdraw your OPT application and submit a new one, requesting less than one year. There are several reasons why you should not do this now.
·         You should wait for confirmation that your first OPT application has been withdrawn before you submit a second application. Since you are very close to the end of your 60-day grace period, it is unlikely that you will receive this confirmation before April 1st (deadline to submit the new application).
·         If you did withdraw and submit a new OPT application to USCIS now, it will likely still take 90 days to process your application, meaning that you may not be able to begin working until June or July.

没有了OPT，就得考虑再次留学的意义了:$
