Some people believe that there should be fixed punishments for each type of crime. Others, however, argue that the circumstances of an individual crime , and the motivation for committing it, should always be taken into account when deciding on the punishment.
Discuss both these views and give your own opinion.

Thereported uprising number of crimes and recidivism rates have had the publicengaged in the discussion of what is the best way of approaching punishmentwith law. Apparently, laws are written delicately to judge and determinepunishment as clear and accurate as possible. But in reality, each crimeinhabits specific circumstances that greatly complicate the case.

Some people persist that it is most necessary to apply a fixed punishmentthat is not determined by external factors. Law codes are designed and enforcedfor a reason and punishment will not be justified if they do not correspond tothe precise description of the code or follow the legal process. Inaccurate penaltieswill violate the principles of law, which predominantly protect and ensure theequality of every individual in the legal system.

However, another voice in the argument does not totally agree. They put forwardthat different situations and motivation of crimes have inevitable influenceson the offender, neglecting these elements would leave out a crucial aspect ofcrime investigation in the court. Additionally, these information help decide whetherthe type of penalty provides sufficient rehabilitation for the defendant. Therefore, anyjudgment without these considerations should be impartial and prejudiced andcould lead to cruel punishments.

Althoughthe opinions are quite conflicting, it ispossible that we find a balance in between. On the onehand, we take full use of the well-written law codes and procedures to analyzethe facts and categorize the behavior. And on the other, we could utilizebackgrounds of the incident and the suspect’s psychological activities tolocate the style and degree of the punishment. Both actions can be integratedwith each other to maintain the order of the society, and encourage better moralityamong its members.
