issue17. "There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws."
(641)
The system of laws lays the foundation of social security and maintains the social stability by means of regulating mass people's daily behavior. Yet, not all laws in the system are considered just and fair, it is understandable for people to obey just laws, while it is controversial to disobey unjust laws. In my point of view, whether to disobey the laws depend on how serious they are morally unjust and unfair.
Through out the history, codes and laws are indispensable to social development, and only when the majority of people accept and obey those rules can the society remain stable, with the precondition that these laws are just. Just laws take the interests of the majority into consideration, and aim at socially stable and secure. Accept and behave accordingly to such regulations can be beneficial to observers and to the whole society as well.
When it comes to unjust laws, it is always hard to judge whether they are morally unjust with a universal and unified standard, different groups of people with varied interests may have different definitions. Take tax laws as an example, businessmen in large corporations may consider it unfair to pay a great sum of money as taxes for the money are gained by their hard work, but on behalf of the mass and government, certain taxes collected from them is just and understandable for business are enjoying the economical environment and public utilities, and it is their duty to take some of their revenues to better the public. Moral standards towards justice varies greatly from nations and religions as well, in this sense, it is not an easy task to judge whether a law is just or unjust.
If people are encouraged to disobey and resist personal deemed unjust laws, it is conceivably that the society would turn out to be in a mess and in disorder. Before the newly revised version of Transportation Regulations of China, there was a regulation claiming that when an accident happens involving both a vehicle driver and a pedestrian, if it is the fault of the walker, the driver takes no responsibility to the accident even if the walker is seriously injured or even killed. This is considered to be unjust by many people because the walker is apparently the inferior part in this occasion. If people disobey and resist the unjust regulation, it would have little help to the situation, and rather, it would cause more traffic accidents and finally lead to hazardous traffic disorders. In this case, disobedience is not a wise action to remove the unjust factors in laws, the practical method is to turn to legislators for help. It was suggestions rather than resistance that gave birth to the revised version of Traffic Regulations which cross out the unjust article mentioned above.
However, disobedience and resistance of unjust laws are needed in certain situations, in which the laws damage the interests of a large group of people or that of a whole social class, or even threaten their existence. Mass disobedience may be the only solution to regain their rights and to restore justice and equalities. Take a look at the struggling history of Indian people that happened last century, the English governors made many unfair business laws against local people at that time, the Indian finally regained their dependence under the lead of Gandhi through years of resistance to buy English produced products. Disobedience is effective to fight against unjust laws in this case.
In this developing society, laws which act as basic structures to the whole building are developing as well, flaws and errors are inevitable, in general, we should obey just laws and obey slightly unjust laws as well, in order to maintain social stability, whereas, disobey unjust laws that are basically against mass people's interests and badly threaten the existence of them.
