TOPIC: ISSUE17 - "There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws."

提纲:当把道德观念引进法律时,法律会显得unjust
              法律应该遵守;
              法律有错时(不同的时间,地区),需要相应的修改。

Law means a rule which is capable of enforcement through instruction and regulates the human beings. Accordingly, people should obey the laws. However, I disagree with the argument that every individual has a responsibility to disobey and resist unjust law depend largely upon what I believe to be the definition of "unjust".

Just is concept for certain moral requirement based on the sense of right or wrong according to conscience. Although the moral requirement, regarded collectively, stand higher in the scale of social utility and of more paramount obligation, there are cases may occur which overrule any one of the general maxims of justice. For example, to save a life, it may not only be allowable, but a duty, to steal, or take by force, the necessary food or medicine. In such cases, this behavior disobey what the law has regulated with doubt, but do anyone has the heart to see the person, who has no criminal record and is in such situation only because someone else has just stolen all of his money, is going to die?
Every individual, including the person who make the law, has his or her own moral code and in some cases, if we bring the moral standards in to the law, the law may become unjust and the law shouldn't lose its force and effect when its seems unjust from the point of view in moral.


Since the politicians who do his best to keep the society stable and direct the development of the society enact the law, people should obey the law. For instance, the army cannot stand attack on condition that the soldiers only obey the commands which they regard are right and disobey the wrong ones in their opinion in a battle. The army is like the society, the leader wants every soldier to defer his order and submit to his appoint, then that will make a united army. So it is the same with the law, if people choose some clauses of the law to obey or disobey by means of
their own outlook, then the law cannot
be carried out and it will lose it function that bring stability to the society.


There is no doubt that laws are made for a reason and the laws of a society reflect the values of the tradition, necessity and expectation of the society. For a legal system to work for a society, the law must be knowable, fair, and implemented equally among the individuals. Whereas, there will be a law which is unjust and even wrong not for every, but for a group of people. If the law contradicts the local cases, such as religion and custom, it is right for them to protest against it in a reasonable way. Thereby, politicians should aptly adjust the laws base on the local situations. At the same time, legislature should adjust the law with the time going by. So the law should be flexible and adaptable in certain positions, places and times, although seems rigorous.

From the analysis above, whether the law is just or not should not be judged by our individuals.Although law may seem improper and somewhat unjust for some groups of people in certain situations, it is our duty to obey the laws.

(根据良心,公正是关于道德的概念。关于句式,according前面应该加个逗号,关于观点,你需要再三斟酌,因为国外的杂志和著作都会用just来修饰laws,例如:http://www.icr.org/just-laws/ But to have just laws enforced, truth must be distinguishable from falsehood, and right from wrong. Does such a law exist?
